Let Down

When I spoke earlier in the Blog about how The Police and C.P.S. had let Tony Gorman and his family down, by failing to investigate his Murder properly. I forgot to mention how they also failed Shelley Mitchelson. Here was a young girl who just happened to witness, possibly the worst thing imaginable. Having made her statement to the Police a day after the Murder, she is then asked to attend 2 I.D. parades three months later. She doesn't shy away from picking out who she thought was resposible for this horrific attack. Something many people would probably have done. Shelley Mitchelson along with her boyfriend Gary did more than anybody to help solve this Murder and they were both deeply let down.

The Blue and White Hooped Rugby Shirt

I'm not going to say too much about the statement, I've already mentioned there was statements to contradict Wither's saying he left at 12.30am. What I do want to talk about is all the people that came forward on his behalf, to say they had never seen poor old Gary wearing a blue and white hooped rugby shirt, EVER. Withers himself in his interviews under caution said he had only ever wore it once when it was first bought, about a year earlier. So when mummy, mummies partner, Gary's girlfriend and about ten or so of his good old honest buddies came forward in May to say they hadn't seen him wearing it. That was meant to throw weight to his defence and contradict Shelley Mitchelson's evidence. What it actually did, if you think about it logically, it damn near made it impossible for Shelley Mitchelson to be wrong. Unless of course she has "Uri Gellar" type powers and could guess what Gary fucking Withers had in his wardrobe!! I'm going to repeat myself because I think it is SO IMPORTANT. Gary Withers in his Police interviews insisted several times that he had only ever wore his blue and white hooped rugby shirt once when it was new over a year prior to the Murder. When interviewed by the Police in May not one of Gary's friends said they had ever seen him wear it. So somebody please tell me how Shelley Mitchelson manages to describe him wearing it? Did she sneak into his house and hang it in his pissing wardrobe? Of course not. Did the Police and Crown Prosecution Service fail to see this logic? Of course they did they missed everything else for God's sake!!

I am the above named person and I live at the address overleaf. In the incident I am about to describe I was wearing blue jeans, a beige sweatshirt with a roll neck collar and white trainers. On the evening of Friday 1st. March, 1991, 1 went for a drink with Carl GREEN of 15 Camfrey, Kings Lynn. I can only recall that he was wearing jeans. We went into Kings Lynn town centre somewhere between 8 o'clock and half past 8 that night. We went to the Malting’s, Paige Stair Lane, The Maydens Head, The Wenns, Chicago’s and the Lattice House, before returning to the Maydens Head. In there in on my second visit I met up with Howard ALLAN. About quarter to 11 I left the Maids with Howard and Carl, I can't remember who was there for sure except for Carl. When I got to the Cellar Bar I had to pay £1 admission. I do not know who I paid this too. This is only the third time I have been in the Cellar Bar since it has been open so I am not familiar with the doormen and I can't recall which of them were on the door when I went in. The was packed when I got in there. I want to the bar and got a drink. Carl was with me for about another twenty minutes. I don’t know what happened to him after that. I had spoken to Howard ALLAN in the Cellar Bar but only for .a short time. I left the Cellar Bar about half past 12. As I was leaving I saw Howard again and asked him how he was getting home and the two of us decided to share a taxi as we live quite near each other. As we left we passed some people still going in and there was a group of people at the top of the stairs. I don't know who they were. We walked diagonally across the Tuesday Market Place and down Surrey Street, between the two banks. Howard had a look in the window of what used to be Glebe Taxis in Chapel Street. He said there were alot of people in there, so we walked off towards Norfolk Street. We had just got on the corner of Norfolk Street and Chapel Street when an empty taxi came along. We flagged him down it was "Just the Job" taxis. As he didn't have a fare he took to Holten Road, which is where Howard lives and dropped us off. When he picked us up he drove along Chapel Street, past the Lattice House and then took the first right along Austin Street. He then drove us straight to Gaywood. I do not recall seeing any trouble at all during the time that I was in the Cellar Bar. At no time whilst I was in Chapel Street, either on foot or in the taxi did I see any sort or trouble. I must say that my recollections of that night are somewhat hampered in that I was drunk having had about twelve pints, of Guiness. The only person I can remember seeing in the Cellar Bar that I know was Emma the barmaid. I have just remember that as I was walking out of the Cellar Bar I saw the one doorman that I do know, standing at the door, it was Micky TEAL. At this time there was nothing unusual that I noticed about his appearance.

RE: Even more Gary Daw

I touched on it when I was referring to the Forensic evidence and I will post the statements to prove it. Police officers and Prosecutors for the Crown made statements eventually blaming witnesses for failing to provide enough evidence to continue with this case. Gary Daw did more than was reasonably expected of him, he actually handed the evidence to them on a plate. The Police and Prosecution on several occasions said the witnesses were afraid to name names. Gary Daw certainly did and what did they do about it? The usuall, fuck all. When all the shit about the actuall cause of Gorman's death starts to raise it's ugly head, they use that as an excuse to drop the case. Well Mr charnley and Mr francis (prosecutors) you shouldn't need me to tell you that a charge of G.B.H. at that time carried a maximum sentence of LIFE in prison. The very least the Gorman family deserved was to see somebody stand trial for assaulting their son and you couldn't even manage that. SHAME ON YOU,SHAME ON YOU ALL.

In the last of those statements I said that those involved in the attack on Gorman were definitely not Somerton, Teal and Moore. I said that I would be able to recognise those involved again. I have now seen two of the men involved and I have made it my business to find out who they are. I am certain that the large man who came up last of the three is Gary Withers who lives in the Gaywood area of King's Lynn. I am certain that one of the first two attackers was a boy who I know to have the surname xxxxxxx and as I understand it is a fisherman who lives in North End. I have seen both of them in Public Houses in King's Lynn on several occasions recently and have asked people who they are. I am willing to attend an Identification Parade. Turning to Gary Withers and in turn talking about the third of the attackers, this was the big stocky man with black shortish hair. The man xxxxxxx who I saw involved in the assault is tall with black short hair and of medium build rather like my own. They are both in the age group of around 25. I initially thought that this boy xxxxxx first name was Andy, but I cannot be sure of that. I have not come forward before because I did not want to be the person to point the finger until I was sure and as time has gone by and I have seen them on several occasions have become certain that they are two of the attackers. It is for that reason that I came forward to Mr Britton's Office on the night of the 7th May and at his request have made a statement in the presence of Sergeant Tom Neill. Of these two, xxxxxx was actively involved in kicking and punching Gorman. Withers was the last there. I remember that he held Gorman around the neck area but by his clothing. I cannot be sure if he punched the man but he certainly did not kick him. The other main attacker was with xxxxxx. He was shorter than xxxxxxx with mousy hair. I can be sure that Gorman had been chased round by the second Ward Gethin Office opposite the Tudor Rose and into Chapel Street and had not run across the car park. The first two men were about 15 metres behind Gorman. He ran across towards the Council Offices. By this stage me and Shelley had just turned round by the Lattice House on the opposite side of the street. The third man was lagging behind them. They caught up with Gorman as he got across onto the pavement. I saw both of them hit him and he went down. I think both of them had punched him. Certainly one had. He fell to the ground. The third was about 10 metres behind the first two and as he joined up with them the first two were kicking Gorman on the ground. They were kicking him about the upper part of the body. They kicked him repeatedly. This was once he was on the floor. They were at this stage joined by the third person. All I saw him do was pick up Gorman by the scruff of the neck but by the clothing in that area and at that stage the first two had stopped kicking Gorman. I had been absolutely opposite the first two when they were kicking the man. The third had come jogging up behind them. I cannot say if the third person did or did not hit Gorman but he definitely did not kick him. That was the last I saw of these three men. Indeed having passed the first two as they were kicking the deceased I walked on with Shelley. I then obviously saw the third jogger run up to them which meant he went passed us. I then looked back only once or twice and then only briefly. We had got about 10 metres passed the first two when the third man caught them up. I glanced over my shoulder as we carried on walking and it is then that I saw him holding the man Gorman. We carried on walking and then I glanced back again and they were gone. There is no time in my mind in which the third man would have had an opportunity to do anything further to Gorman in between my looking the first time and looking back the second time to find that they had gone, but when I looked back the injured man was lying on his back, his body was over the pavement and his head on the curb. He feet were facing towards me. Then I refer back to my first statement and meeting Clifford Ellis. I cannot remember if the lights were on in Chapel Street when the assault was going on but I think they would have been and I certainly could see clearly. Thus I can describe the first two attackers as follows. As to the man xxxxxxx he was about 25 years of age. He was 6' or thereabouts, perhaps slightly taller. He was of slim to medium build (about my build). He had dark hair, it was black, it was cut short but not in any particular style. I cannot remember what he was wearing; it was his face that I was looking at. He looked clean shaven and there was no obvious beard or moustache. The second man with him was not so tall, somewhere between 5'8" and 5'10". He was of medium build but heavier than the first of the two. He had collar length short hair which was mousy brown. He was clean shaven and again I cannot remember what he was wearing. The third man, Gary Withers, was about 25 as were the other two. Again he was white. He was of stocky build and somewhere between 5'10" and 6' in height. He was more fat than stocky. He had black hair, it was cut shortish and again in no particular style and I cannot remember what he was wearing. At the Identification Parades that I attended I did not see any of these three on them. I went to three Identification Parades. On the first I recognised Carl Somerton on it. On the second I recognised Michael Teal, and on the third Rod Moore. I picked none of them out and could definitely say if I had been asked by the Police that it wasn't any of them involved. I can say this without any doubt at all. Since then I have on various occasions seen those who were involved about King's Lynn. I have made enquiries to find out their names. I am now sure that they were the three involved on that night. I have made enquiries and I now know that, as I have said already, one of them is one of the xxxxxxx brothers who live in North End, and I think he is a fisherman. This is the dark haired slim one I have described as kicking Gorman. The second one, I do not know his name, but I have seen him maybe twice with xxxxxxx since the incident. Another time I saw him in the Lattice House. On each occasion I have seen them in the pub. Since the incident he started growing a beard. I have asked people in the pubs who they are and that is how the name xxxxxxx came up. The one growing the beard I last saw eight or nine days ago. The third fattish one I have seen around and indeed before the incident. I did not then know what his name was. The last time I saw him was a couple of week ago in a pub in the Tuesday Market Place and I found out that his name was Gary Withers and that he lived in the Gaywood area. I found his name out by asking people in the pub in a quiet way. I recognised them first as being involved and then I made enquiries to find out who they were. I did not know any of them prior to the incident. I would recognise all three of them if I saw them again and I have no doubt the persons I now know to be Withers and xxxxxxx were involved that night and I am willing to attend any Identification Parades.

RE: The Forensic Evidence

I was always addamant in my Police interviews that Forensic evidence would clear me of any involvement in the Murder of Tony Gorman and hey what do you know they did. The statement was a long time coming, I don't know how long these things usually take, but I would guess 3 1/2 months is not the norm. I mentioned earlier the excuses the C.P.S. came up with for not having them. they were as follows:- Mr MacKirdy was on a course, he was on compassionate leave or he was on holiday. To me they were just excuses. My worst nightmare was the filth were going to tamper with the evidence, after all, together with the C.P.S. they did other underhand things.
It's a long document to read so let me just briefly explain what it found.
My blood was found on both Sewell, Rod Moore and outside the Cellar Bar, but not on Gorman. Absolutely nothing linked me to Tony Gorman and nothing linked Tony Gorman to me. The patterned shoe mark found on his face and in the blood by his body couldn't have been done my my shoes as they didn't have any patterns on. They were infact plain leather "brogues" with a "metal seg" in the heel. The Police and C.P.S. fucked up and nobody else. I will post statements from senior officers who blamed the witnesses later so stay tuned.

On the 11th March 1991 the following item was received at the laboratory from Police Constable BANKART:
JH/1 Paving slab - near gate of St Nicholas's Church, St Ann’s Street, King's Lynn.

Information received:-
During the evening of 1st March 1991, Anthony GORMAN (deceased) in company with Gary SEWELL visited a number of public houses in King's Lynn, eventually visiting the Cellar Bar in Page Stair Lane during the late evening.
Michael Andrew TEAL and Rodney Alan MOORE were employed amongst others as doormen at the Cellar Bar.
After an incident in the Cellar Bar in which a TV monitor was broken, one of the doorman got hold of Mr. GORMAN by the throat and pinned him up against a pillar. A number of glasses were smashed and Mr. GORMAN was subsequently ejected from the bar by the doorman. The doorman then returned to the bar.
At about closing time an incident occurred at the top of the steps of the Cellar Bar involving Mr. TEAL and Mr. SEWELL. Head injuries were sustained by both persons; Mr. TEAL was restrained by Mr. MOORE and others. Mr. SEWELL managed to get away.
A scuffle also occurred at the top of the steps involving Mr. GORMAN. After an argument with Mr. SOMERTON, Mr. GORMAN was seen to grab hold of another man. A few minutes later Mr. GORMAN was seen lying halfway down the steps.
Subsequent to the incidents at the Cellar Bar Mr. SEWELL went down Page Stair Lane towards the Tudor Rose Hotel. Mr. GORMAN joined Mr. SEWELL and stood talking outside Nos. 14/14A Tuesday Market Place. They were then approached by three men. Mr. GORMAN ran off down St Nicholas Street chased by three men who caught up with him outside the Tudor Rose Hotel. Mr. GORMAN was punched and again ran off with the three men in pursuit. The three men caught up with him in Chapel Street, where he either fell or was knocked down. Whilst lying on his back Mr. GORMAN was repeatedly kicked in the head by each of the three men. One of these also held GORMAN's head and punched him about the face. The three assailants then ran off.
Mr. SEWELL left the area and got a taxi to the Queen Elizabeth Hospital. Another witness to the incident called an Ambulance.
Mr. TEAL and Mr. MOORE were observed approaching the scene of the incident from the general direction of Norfolk Street by Police Officers. Mr. TEAL passed a comment to the Police Officers and then ran off. He was later arrested in Hextable Road. Mr. MOORE walked past the scene and was picked up by the owner of the Cellar Bar in his vehicle. Mr. MOORE was then transported back to the Cellar Bar, where he was arrested.
Mr. SOMERTON was arrested later the same day.
A Post Mortem was carried out on Mr. GORMAN by Dr. HARRISON at the James Paget Hospital, Gorleston, where the cause of death was given as Pulmonary Oedema as the result of a severe beating. Mr. GORMAN had also sustained a broken nose.
None of the accused admit the offence.
Mr. TEAL has been charged with grievous bodily harm on Mr. SEWELL.
In addition to items RJL/3 and RA/44 I have also seen photographs of the body of Mr. GORMAN in situ at Chapel Street, King's Lynn.
I do not know whether Mr. MOORE or Mr. SOMERTON sustained any injuries relating to the incident at the Cellar Bar.
Purpose of laboratory examination:-
The laboratory examination is required to establish:
(1) Whether the clothing, footwear and swabs from the accused bear blood shed by Mr. GORMAN.
(2) Whether the upper clothing and swabs from Mr. TEAL bear blood shed by Mr. SEWELL.
(3) Whether the upper clothing and swabs from Mr. SEWELL bear blood shed by Mr. TEAL.
(4) Whether the clothing from Mr. GORMAN bears blood shed by Mr. TEAL.
(5) Whose blood was shed in Page Stair Lane, Tuesday Market Place and Chapel Street?
(6) Whether the marks on the face of Mr. GORMAN were made by footwear from the accused.

Grouping Tests - blood samples and bloodstained items:-

Items from Anthony GORMAN (deceased):-
The jeans (DAH/13) and top (DAH/16) each bear widespread areas of bloodstaining. The right shoe (DAH/7) bears two small spot stains which have given positive reactions to a test indicating the presence of blood.
Grouping tests have been performed on a total of seven bloodstained areas from toe jeans and top. Nothing has been found from the results of these grouping tests which would demonstrate the presence of blood other than Mr. GORMAN's on these items.
Grouping tests on one area of bloodstaining from the jeans, have not worked.
There is insufficient staining on the right shoe for grouping tests to be performed or for further tests to confirm the presence of blood. No bloodstaining has been found on the following items:-

Items from Michael Andrew TEAL:-
The shirt (MCD/1) bears extensive bloodstaining, mainly on the front and sleeves. Most of this blood is in the form of splashes, which are heaviest on the upper part of the front and on the forearm regions of both sleeves.
The trousers (MCD/2) bear smears of blood on the upper part of the front and on the linings inside both the right and left hip pockets. The pair of shoes (MCD/3 and MCD/4) bear scattered small spots of blood, mainly on the fronts of the uppers.
The swabs LKA/5 to LKA/10 each bear traces of staining which have given positive reactions to a test indicating the presence of blood.
Grouping tests have been performed on a total of eight bloodstained areas from the shirt, trousers and left shoe. Nothing has been found from the results of these grouping tests which would demonstrate the presence of blood other than Mr. TEAL’s on these items.
There is insufficient blood on the right shoe for grouping tests to be performed.
There is insufficient staining on the swabs LKA/5 to LKA/10 for grouping tests to be performed. The presence of human blood has been confirmed on the swab LKA/9 from the left zygoma. No further tests have been performed on the swabs LKA/5 to LKA/8 and LKA/10 to confirm the presence of blood.
No bloodstaining has been found on the following items:-
LKA/l Nail scrapings - right hand.
LKA/2 Nail scrapings - left hand.
MCD/11 Right sock.
MCD/12 Left sock.
Items from Gary William SEWELL:-
The shirt (DFC/l) bears extensive blood splashing, mainly on the upper parts of the front and sleeves. The jeans (DSC/2) bear scattered small blood splashes, mainly on the front, extending from the top to the bottom of the legs. The pair of boots (DSC/3and DSC/4) bear small spots of blood, mainly on the edges of the soles. Each of the swabs (RJN/2 to RJN/5) relating to the head, chest and hands bears bloodstaining.
Grouping tests have been performed on a total of four bloodstained areas from the shirt and jeans and on each of the five bloodstained swabs. (None of the bloodstained areas tested from the shirt and jeans belong to groups in common with the blood sample from Mr. SEWELL.
Some of these bloodstained areas belong to groups in common with the blood sample from Mr. TEAL. In my opinion these findings support the contention that Mr. SEWELL had been involved in an incident with Mr. TEAL when the latter was bleeding from a head injury.
In the presence of blood which could have been shed by Mr. TEAL, nothing has been found from the results of other grouping tests on these items of clothing which would demonstrate the presence of blood from Mr. GORMAN.
Grouping tests performed on blood from each of the swabs (RJW/2 to RJW/6) have not worked.
There is insufficient blood on the spots (DSC/3 and DSC/4) for grouping tests to be performed.
Items from Rodney Alan MOORE:-
The shirt (MCD/5) bears widespread bloodstaining, much of which is in the form of minute splashes. The trousers (MCD/6) bear occasional spots of blood, mainly on the upper part of the front. The shoes (MCD/7 and MCD/8) bear traces of bloodstaining on the fronts of the uppers.
The swabs (LKA/19, LKA/21 to LKA/25) and nail scrapings (LKA/15) from the left hand bear traces of staining which in each case have given positive reactions to a test indicating the presence of blood. The presence of human blood has been confirmed on the swabs (LKA/23 and LKA/24) respectively from the upper lip and corner of the mouth.
Grouping tests have been performed on a total of ten bloodstained areas from the shirt, trousers and pair of shoes and on the swabs from the lip and corner of the mouth.
Some of the blood from the clothing of Mr. MOORE belongs to groups in common with the blood sample from Mr. TEAL. In my opinion these findings are consistent with information that Mr. MOORE had intervened in an incident involving Mr. TEAL when the latter was bleeding.
One area of blood staining tested from the clothing of Mr. MOORE belongs to a group common with the blood samples from both Mr. SEWELL and Mr. MOORE. In my opinion this finding is consistent with information that
Mr. MOORE had intervened in an incident involving Mr. SEWELL when the latter was bleeding. However I have not excluded the possibility that the blood could have been shed by Mr. MOORE himself.
In the presence of blood which could have been shed by Mr. TEAL, Mr. SEWELL or Mr. MOORE, nothing has been found from the results of other grouping tests on bloodstaining from Mr. MOORE'S clothing or footwear which would demonstrate the presence of blood from Mr. GORMAN.
Grouping tests on bloodstaining from the right shoe and from the swabs of the upper lip and comer of the mouth have not worked.
There is insufficient staining on the swabs (LKA/19, LKA/21, LKA/22 and LKA/25) and on the nail scrapings (LKA/15) from the left hand for grouping tests to be performed. No further tests have been performed on these items to confirm the presence of blood.
No blood has been found on the following items:-

Items from Karl Robin Brian SQMERTON:-
The shoes (JDB/2 and JDB/3) bear small splashes of human blood on the edges of the soles and traces of blood on the fronts of the uppers.
The jacket (SRB/3) bears staining on the inside edge of the left front which has given positive reactions to a test indicating the presence of blood.
There is insufficient staining on the shoes and jacket for grouping tests to be performed. No further tests have been performed on the staining from the jacket to confirm the presence of blood.
No blood has been found on the following items:-

Swabs of blood from Page Stair Lane:-
The bloodstaining on swabs 4 (RA/7), 7 (RA/13) and 11 (RA/21) belong, to a blood group in common with the blood samples from Mr. TEAL and Mr. SOMERTON.
Grouping tests on the bloodstaining on swabs 9 (RA/17) and 12 (RA/23) have not worked.
Swabs of blood from Tuesday Market Place:-
The bloodstaining on swabs 14 (RA/27) and 19 (RA/37) belong to a combination of blood groups in common with the blood sample from Mr. SEWELL. ]
Swab of blood from Chapel Street:-
Grouping tests on bloodstaining on swab 20 (KH/2) have not worked.
Paving slab, near gate of St. Nicholas's Church, St Ann’s Street:-
No blood has been found on item JH/1.

The photograph (RJL/3) of Mr. GORMAN's face shows marks which could have been made by undersurface pattern elements of the soles of one or more items of footwear.
The following pairs of shoes have no undersurface pattern on the soles;
MCD/3 and MCD/4 Mr. TEAL
MCD/7 and MCD/8 Mr. MOORE
JDB/6 and JDB/7 Mr. SOMERTON
In my opinion it is unlikely that these shoes could have made the marks on Mr. GORMAN's face.
The following pairs of shoes or boots have undersurface patterns on the soles:
JDB/2 and JDB/3 Mr. SOMERTON
JDB/4 and JDB/5 Mr. SOMERTON
DSC/3 and DSC/4 Mr. SEWELL
In my opinion the marks on Mr. GORMAN's face are too indistinct for meaningful comparisons to be made with these items of footwear. I am therefore unable either to attribute the marks on Mr. GORMAN's face to particular items of footwear or to exclude them.
Video recording, area from Page Stair Lane to Chapel Street and the body of Mr. GORMAN:-
I have examined this recording for the purpose of establishing the extent and distribution of blood shed in the region of Mr. GORMAN's body.
I have also seen photographs of Mr. GORMAN's body in situ at Chapel Street.
My observations lead me to believe that most of the blood in the vicinity of Mr. GORMAN's body is likely to have been shed by him whilst he was lying on the ground after the assault had ceased. No significant amount of blood splashing is visible.
I have observed what appear to be partial footwear marks in blood on the pavement between the body and the wall and on the road adjacent to the body. These marks contains pattern elements which appear to be different from the undersurface patterns of the shoes (JDB/2 to JDB/5) from Mr. SOMERTON and the boots (D3C/3 and DSC/4) from Mr. SEWELL.
SUMMARY AND CONCLUSIONS:-
Nothing has been found to show the presence of blood, other than his own on the clothing from Mr. GORMAN.
Nothing has been found to show that marks on Mr. GORMAN's face and on the ground in Chapel Street, had been made by items of footwear relating to Mr. TEAL, Mr. SEWELL, Mr. MOORE or Mr. SOMERTON.
Nothing has been found to show that blood from Mr. GORMAN had been shed onto items relating to Mr. TEAL, Mr. SEWELL, Mr. MOORE or Mr. SOMERTON.
Nothing has been found to show the presence of blood other than his own on items from Mr. TEAL.
The clothing from Mr. SEWELL bears blood from another person. In my opinion the findings show that Mr. TEAL is the person most likely to have shed this blood.
The clothing from Mr. M00RE bears blood from more than one person.
In my opinion the findings show that Mr. TEAL is likely to have shed some of this blood. The findings also show that some of the blood from Mr. MOORE'S clothing could have been shed by Mr. SEWELL. However Mr. MOORE cannot be excluded as a possible source of this blood.

Stair Lane are most likely to have been shed by Mr. TEAL.

SUMMARY OF CIRCUMSTANCES
The deceased had been involved in an altercation at a nightclub in Kings Lynn and was ejected. Fighting continued outside the club where the deceased was thought to have fallen down a flight of steps. He then made off and was found dead some 300 metres from the scene of the altercation. A request was made by Detective Superintendent that I carry out an autopsy and the body was therefore transported to the James Paget Hospital Mortuary.
EXTERNAL EXAMINATION
The Body was that of a well-nourished adult Male 1.7m (5'71/2") in height and weighting 79kg (12.4st). Rigor mortis was present and generalised and hypostatic lividity was moderately well developed and limited to the posterior surface of the body. External injuries were present as follows:
HEAD & NECK:
Multiple irregular areas of abrasion over the front and right side of the forehead.
Right peri-orbital haemorrhage (black eye).
Swollen nose and bruising and abrasion of the bridge. Nasal bones obviously fractured.
Patterned abrasion right cheek over an area measuring 3 X 4. 5cm.
Linear abrasions upper lip on the right side, lips swollen and bruised.
Abrasion to left of chin.
Three separate abrasions to left cheek.
Abrasion 0.7 X O.6cm on the top of the head, to the left of the vertex.
Bruising to right side of neck.
Subconjunctival petachial haemorrhages right lower eyelid.
Tattoo on vertex of scalp.
CHEST & ABDOMEN:
Small abrasions related to the radial one third of the right clavicle.
Two vertical linear scratches of the right hypochondrium.
Tattoo around umbilicus.
ARMS & LEGS:
Tattoos right shoulder, upper and lower arms.
Tattoos left forearm.
Recent bruise left hip.
Old bruises back and front of left thigh.
Scar over right knee.
HANDS:
Right, diffuse bruising over the medial dorsum and over the dorsum of the proximal phalanges middle and ring fingers. Localised abrasions 0.3-0.4cm over dorsum of hand in line with middle finger and also over the dorsum of the middle phalanges of the middle and ring fingers.
Left, abrasion over dorsa distal interphalangeal joint of thumb and proximal interphalangeal joint of middle finger.
Abrasion medial edge of wrist.
2.2cm horizontal scar dorsum of hand medially.
Old scars over thumb proximally.
Abrasion over palmar surface of the thenar eminence.
INTERNAL EXAMINATION
HEAD
Scalp: Deep bruising to the left parietal scale near the vertex. Deep bruising of both temporal muscles.
Skull: Increased in thickness, 0.4cm in the mid-coronal plane, 1.4cm in the occipital region. No fractures.
Dural Sinuses, Meningss, C.S.F.Natural.
Brain: Weighed 1560 gram and appeared swollen. There was flattening of the gyri with injection of small cortical vessels. There was no obvious cortical contusion. Cerebral vasculature transparent. Brain fixed intact for later examination.
RESPIRATORY TRACT
Mouth:
Lips: Bruised and swollen.
Tongue: Bruised anteriorly at left lateral border.
Teeth: Own teeth present. Approximately two-thirds of the lower left lateral incisor broken and not present with body.
Airways: Contained aspirated fresh blood from fractured nasal bones.
Laryngeal Skeleton: Intact. No evidence of aspirated gastric contents. No bruising of deep neck structures. Pleural Cavities: Moist. No adhesions.
Lungs: Weighed right 730 gram, left 730 gram. Both were congested and oedematous. Scanty subpleural petechial haemorrhages noted.
CARDIO-VASCULAR SYSTEM
Pericardium: Natural.
Pericardial Cavity: There was a small pericardial effusion.
Heart: Normal in size and contour and weighed 360 gram. Valve circumferences were within normal limits. Valve cusps smooth and mobile.
Chordae tendineae not thickened. Nyocardium appeared healthy. Both coronary arteries were free from atheroma and their lumina widely patent.
Aorta: Natural.
Pulmonary Artery: Natural.
GASTRO-INTESTINAL TRACT
Oesophagus: Natural.
Stomach: Dilated by a recently ingested meal. Smell of alcoholic beverage noted.
Small & Large Intestines: Natural.
Peritoneal Cavity: Dry. No adhesions.
Hernial Orifices; Intact.
Liver: Weighed 1370 gram. Capsular and cut surfaces natural.
Gall Bladder: Thin-walled. No calculi. Bile ducts patent. Pancreas: Natural.
GENITO-URINARY SYSTEM
Kidneys: Both kidneys were normal in size and contour and weighed right 150 gram, left 165 gram. The capsules stripped easily revealing smooth external cortical surfaces. Cut surfaces natural.
Pelves, Ureters: Natural.
Bladder: Dilated by approximately 250ml of clear urine. Prostate: Natural.
External Genitalia: Natural.
OTHER ORGAN SYSTEMS
Endocrines: Pituitary Thyroid, adrenals, natural. LYMPHO-RETICULAR SYSTEM
Spleen: Weighed. 100 gram. Capsular and cut surfaces natural.
Lymph Nodes: No obvious lymphadenopathy.
SKELETAL SYSTEM
Fractured nasal bones. No other obvious skeletal abnormalities.

SUMMARY AND CONCLUSIONS
A previously healthy adult male who had suffered a severe beating, mainly to the head. The patterned abrasion to the right side of the face is consistent with the deceased having been stamped on whilst on the ground. Defence injuries were minimal and many, or all of them, could have been caused by a fall down the steps outside the night-club.
The head injuries resulted in brain damage which produced pulmonary oedema and death.

Gruesome Evidence



Even with the two new arrests and the further statements of Clifford Ellis and Gary Daw saying they were certain it was not me or Karl, the prosecutor ian francis still applied to keep us in prison.
What's interesting to note is philip charnley is taken off the case. ian francis the prosecutor now handling the case follows charnley's footsteps, by again misleading the court whilst summarizing what happened. He said "Mr Gorman and Mr Sewell were noisy but only seemed to annoy Mr Teal. At one stage a television was knocked over. Mr Teal got hold of Mr Gorman, pinned him against a pillar......."
By Sewell's own admission I made a joke about the T.V. getting knocked off the wall, which incidently had nothing to do with me grabbing hold of Gorman. I should also add I have at least a dozen statements from different people who came into conflict that night with Gorman. Some from girls who say he pulled them about or tried to kiss them, lads who said he stood at the bottom of the stairs leading back from the toilets were he tried to frisk them for weapons. Robert White the other friend of Gorman, described Gorman as a "physco" to a lad Gorman had swore at. I could go on and on, so there was plenty of evidence to suggest that Gorman had "annoyed" alot of people that night. Again all this evidence was over looked because it had fuck all to do with me and didn't fit. francis couldn't even get it right about the man who tried to save Gorman's life, he wasn't a taxi driver at all. I know the lad in question he's a plumber by the name of Eamon. He deserves a thank you for his efforts.

Gary Withers and Howard Allen

If you have read all the statements thus far you need congratulating, thank you for taking the time. Things started going pear shaped for the Police and C.P.S. here on in. You see they had concentrated all their efforts on trying to make a case against Rod, Karl and myself even when it was plain to see there wasn’t one. When one of the original witnesses then started to say he had seen the people who he believed to be responsible for Gorman’s Murder, while Karl and I were in prison things were going to prove difficult for them. Let me give you a brief outline of events before I start posting more statements. Gary Withers was the next person to be charged, let me explain how. Withers and Allen, like all good citizens came forward and made statements to the Police after the Murder was made public. Without stopping to look I think it was about 3 weeks after the event that they gave their statements. They stated they were at the club but left before any trouble. Withers said in his statement they left at 12.30 am about 50 minutes before the Murder happened. They walked across the Market Place a journey of about 400yards max, before getting a taxi on the corner of Norfolk St. That was about the some of their evidence. I might just add their taxi driver also made a statement a day after the Murder. In it he states 2 lads flagged him down in Norfolk Street at 01.19am, both were heavily out of breath, as he drove past the body of Gorman, Howard Allen made a comment about Gorman being pissed, before taking them home. The taxi driver, Mr Keith Jarvis was so concerned he actually drove back to the Murder scene and told the Police officers present about these two lads. But the officers weren't concerned. Aaaargh, excuse me but it does sometimes make me want to scream. I lok back at this case and think , if only and this is one of those times. Anyway Jarvis's and other evidence contradicted that of Withers and Allen who had claimed they had left at 12.30am before any trouble started at the club. In all probability the taxi drivers statement was singularly the most significant piece of evidence the King’s Lynn Police FAILED to follow up. Let me explain. If the Police were investigating this Murder with an open mind then perhaps 2 men who were picked up by a taxi 200 yards away from the scene of the crime both heavily out of breath they might have considered this a lead worth following. Not to the half wits leading this investigation, it was fucking missed. Apparently another lead not worth looking in to.So when Gary Daw actually sees the people he believes are responsible a couple of months later he finds out their names and makes another statement. The Police have to act now as this young man has in effect done the Police work for them. When they searched Gary Withers house after arresting him, low and behold they find a blue and white hooped Rugby shirt. Amazing!!
If the Police had acted properly during this inquiry and investigated this Murder in the way the Gorman family deserved then I believe Gary Withers and Howard Allen might rightly have stood trial for the Murder of Tony Gorman.
