On the 11th March 1991 the following item was received at the laboratory from Police Constable BANKART:
JH/1 Paving slab - near gate of St Nicholas's Church, St Ann’s Street, King's Lynn.

Information received:-
During the evening of 1st March 1991, Anthony GORMAN (deceased) in company with Gary SEWELL visited a number of public houses in King's Lynn, eventually visiting the Cellar Bar in Page Stair Lane during the late evening.
Michael Andrew TEAL and Rodney Alan MOORE were employed amongst others as doormen at the Cellar Bar.
After an incident in the Cellar Bar in which a TV monitor was broken, one of the doorman got hold of Mr. GORMAN by the throat and pinned him up against a pillar. A number of glasses were smashed and Mr. GORMAN was subsequently ejected from the bar by the doorman. The doorman then returned to the bar.
At about closing time an incident occurred at the top of the steps of the Cellar Bar involving Mr. TEAL and Mr. SEWELL. Head injuries were sustained by both persons; Mr. TEAL was restrained by Mr. MOORE and others. Mr. SEWELL managed to get away.
A scuffle also occurred at the top of the steps involving Mr. GORMAN. After an argument with Mr. SOMERTON, Mr. GORMAN was seen to grab hold of another man. A few minutes later Mr. GORMAN was seen lying halfway down the steps.
Subsequent to the incidents at the Cellar Bar Mr. SEWELL went down Page Stair Lane towards the Tudor Rose Hotel. Mr. GORMAN joined Mr. SEWELL and stood talking outside Nos. 14/14A Tuesday Market Place. They were then approached by three men. Mr. GORMAN ran off down St Nicholas Street chased by three men who caught up with him outside the Tudor Rose Hotel. Mr. GORMAN was punched and again ran off with the three men in pursuit. The three men caught up with him in Chapel Street, where he either fell or was knocked down. Whilst lying on his back Mr. GORMAN was repeatedly kicked in the head by each of the three men. One of these also held GORMAN's head and punched him about the face. The three assailants then ran off.
Mr. SEWELL left the area and got a taxi to the Queen Elizabeth Hospital. Another witness to the incident called an Ambulance.
Mr. TEAL and Mr. MOORE were observed approaching the scene of the incident from the general direction of Norfolk Street by Police Officers. Mr. TEAL passed a comment to the Police Officers and then ran off. He was later arrested in Hextable Road. Mr. MOORE walked past the scene and was picked up by the owner of the Cellar Bar in his vehicle. Mr. MOORE was then transported back to the Cellar Bar, where he was arrested.
Mr. SOMERTON was arrested later the same day.
A Post Mortem was carried out on Mr. GORMAN by Dr. HARRISON at the James Paget Hospital, Gorleston, where the cause of death was given as Pulmonary Oedema as the result of a severe beating. Mr. GORMAN had also sustained a broken nose.
None of the accused admit the offence.
Mr. TEAL has been charged with grievous bodily harm on Mr. SEWELL.
In addition to items RJL/3 and RA/44 I have also seen photographs of the body of Mr. GORMAN in situ at Chapel Street, King's Lynn.
I do not know whether Mr. MOORE or Mr. SOMERTON sustained any injuries relating to the incident at the Cellar Bar.
Purpose of laboratory examination:-
The laboratory examination is required to establish:
(1) Whether the clothing, footwear and swabs from the accused bear blood shed by Mr. GORMAN.
(2) Whether the upper clothing and swabs from Mr. TEAL bear blood shed by Mr. SEWELL.
(3) Whether the upper clothing and swabs from Mr. SEWELL bear blood shed by Mr. TEAL.
(4) Whether the clothing from Mr. GORMAN bears blood shed by Mr. TEAL.
(5) Whose blood was shed in Page Stair Lane, Tuesday Market Place and Chapel Street?
(6) Whether the marks on the face of Mr. GORMAN were made by footwear from the accused.
Examination of Items:-
My examination has been conducted with the aid of assistants.
Grouping Tests - blood samples and bloodstained items:-
The details of grouping tests performed in this case are given in toe following appendices:

Items from Anthony GORMAN (deceased):-
The jeans (DAH/13) and top (DAH/16) each bear widespread areas of bloodstaining. The right shoe (DAH/7) bears two small spot stains which have given positive reactions to a test indicating the presence of blood.
Grouping tests have been performed on a total of seven bloodstained areas from toe jeans and top. Nothing has been found from the results of these grouping tests which would demonstrate the presence of blood other than Mr. GORMAN's on these items.
Grouping tests on one area of bloodstaining from the jeans, have not worked.
There is insufficient staining on the right shoe for grouping tests to be performed or for further tests to confirm the presence of blood. No bloodstaining has been found on the following items:-

Items from Michael Andrew TEAL:-
The shirt (MCD/1) bears extensive bloodstaining, mainly on the front and sleeves. Most of this blood is in the form of splashes, which are heaviest on the upper part of the front and on the forearm regions of both sleeves.
The trousers (MCD/2) bear smears of blood on the upper part of the front and on the linings inside both the right and left hip pockets. The pair of shoes (MCD/3 and MCD/4) bear scattered small spots of blood, mainly on the fronts of the uppers.
The swabs LKA/5 to LKA/10 each bear traces of staining which have given positive reactions to a test indicating the presence of blood.
Grouping tests have been performed on a total of eight bloodstained areas from the shirt, trousers and left shoe. Nothing has been found from the results of these grouping tests which would demonstrate the presence of blood other than Mr. TEAL’s on these items.
There is insufficient blood on the right shoe for grouping tests to be performed.
There is insufficient staining on the swabs LKA/5 to LKA/10 for grouping tests to be performed. The presence of human blood has been confirmed on the swab LKA/9 from the left zygoma. No further tests have been performed on the swabs LKA/5 to LKA/8 and LKA/10 to confirm the presence of blood.
No bloodstaining has been found on the following items:-
LKA/l Nail scrapings - right hand.
LKA/2 Nail scrapings - left hand.
MCD/11 Right sock.
MCD/12 Left sock.
Items from Gary William SEWELL:-
The shirt (DFC/l) bears extensive blood splashing, mainly on the upper parts of the front and sleeves. The jeans (DSC/2) bear scattered small blood splashes, mainly on the front, extending from the top to the bottom of the legs. The pair of boots (DSC/3and DSC/4) bear small spots of blood, mainly on the edges of the soles. Each of the swabs (RJN/2 to RJN/5) relating to the head, chest and hands bears bloodstaining.
Grouping tests have been performed on a total of four bloodstained areas from the shirt and jeans and on each of the five bloodstained swabs. (None of the bloodstained areas tested from the shirt and jeans belong to groups in common with the blood sample from Mr. SEWELL.
Some of these bloodstained areas belong to groups in common with the blood sample from Mr. TEAL. In my opinion these findings support the contention that Mr. SEWELL had been involved in an incident with Mr. TEAL when the latter was bleeding from a head injury.
In the presence of blood which could have been shed by Mr. TEAL, nothing has been found from the results of other grouping tests on these items of clothing which would demonstrate the presence of blood from Mr. GORMAN.
Grouping tests performed on blood from each of the swabs (RJW/2 to RJW/6) have not worked.
There is insufficient blood on the spots (DSC/3 and DSC/4) for grouping tests to be performed.
Items from Rodney Alan MOORE:-
The shirt (MCD/5) bears widespread bloodstaining, much of which is in the form of minute splashes. The trousers (MCD/6) bear occasional spots of blood, mainly on the upper part of the front. The shoes (MCD/7 and MCD/8) bear traces of bloodstaining on the fronts of the uppers.
The swabs (LKA/19, LKA/21 to LKA/25) and nail scrapings (LKA/15) from the left hand bear traces of staining which in each case have given positive reactions to a test indicating the presence of blood. The presence of human blood has been confirmed on the swabs (LKA/23 and LKA/24) respectively from the upper lip and corner of the mouth.
Grouping tests have been performed on a total of ten bloodstained areas from the shirt, trousers and pair of shoes and on the swabs from the lip and corner of the mouth.
Some of the blood from the clothing of Mr. MOORE belongs to groups in common with the blood sample from Mr. TEAL. In my opinion these findings are consistent with information that Mr. MOORE had intervened in an incident involving Mr. TEAL when the latter was bleeding.
One area of blood staining tested from the clothing of Mr. MOORE belongs to a group common with the blood samples from both Mr. SEWELL and Mr. MOORE. In my opinion this finding is consistent with information that
Mr. MOORE had intervened in an incident involving Mr. SEWELL when the latter was bleeding. However I have not excluded the possibility that the blood could have been shed by Mr. MOORE himself.
In the presence of blood which could have been shed by Mr. TEAL, Mr. SEWELL or Mr. MOORE, nothing has been found from the results of other grouping tests on bloodstaining from Mr. MOORE'S clothing or footwear which would demonstrate the presence of blood from Mr. GORMAN.
Grouping tests on bloodstaining from the right shoe and from the swabs of the upper lip and comer of the mouth have not worked.
There is insufficient staining on the swabs (LKA/19, LKA/21, LKA/22 and LKA/25) and on the nail scrapings (LKA/15) from the left hand for grouping tests to be performed. No further tests have been performed on these items to confirm the presence of blood.
No blood has been found on the following items:-

Items from Karl Robin Brian SQMERTON:-
The shoes (JDB/2 and JDB/3) bear small splashes of human blood on the edges of the soles and traces of blood on the fronts of the uppers.
The jacket (SRB/3) bears staining on the inside edge of the left front which has given positive reactions to a test indicating the presence of blood.
There is insufficient staining on the shoes and jacket for grouping tests to be performed. No further tests have been performed on the staining from the jacket to confirm the presence of blood.
No blood has been found on the following items:-

Swabs of blood from Page Stair Lane:-
The bloodstaining on swabs 4 (RA/7), 7 (RA/13) and 11 (RA/21) belong, to a blood group in common with the blood samples from Mr. TEAL and Mr. SOMERTON.
Grouping tests on the bloodstaining on swabs 9 (RA/17) and 12 (RA/23) have not worked.
Swabs of blood from Tuesday Market Place:-
The bloodstaining on swabs 14 (RA/27) and 19 (RA/37) belong to a combination of blood groups in common with the blood sample from Mr. SEWELL. ]
Swab of blood from Chapel Street:-
Grouping tests on bloodstaining on swab 20 (KH/2) have not worked.
Paving slab, near gate of St. Nicholas's Church, St Ann’s Street:-
No blood has been found on item JH/1.

The photograph (RJL/3) of Mr. GORMAN's face shows marks which could have been made by undersurface pattern elements of the soles of one or more items of footwear.
The following pairs of shoes have no undersurface pattern on the soles;
MCD/3 and MCD/4 Mr. TEAL
MCD/7 and MCD/8 Mr. MOORE
JDB/6 and JDB/7 Mr. SOMERTON
In my opinion it is unlikely that these shoes could have made the marks on Mr. GORMAN's face.
The following pairs of shoes or boots have undersurface patterns on the soles:
JDB/2 and JDB/3 Mr. SOMERTON
JDB/4 and JDB/5 Mr. SOMERTON
DSC/3 and DSC/4 Mr. SEWELL
In my opinion the marks on Mr. GORMAN's face are too indistinct for meaningful comparisons to be made with these items of footwear. I am therefore unable either to attribute the marks on Mr. GORMAN's face to particular items of footwear or to exclude them.
Video recording, area from Page Stair Lane to Chapel Street and the body of Mr. GORMAN:-
I have examined this recording for the purpose of establishing the extent and distribution of blood shed in the region of Mr. GORMAN's body.
I have also seen photographs of Mr. GORMAN's body in situ at Chapel Street.
My observations lead me to believe that most of the blood in the vicinity of Mr. GORMAN's body is likely to have been shed by him whilst he was lying on the ground after the assault had ceased. No significant amount of blood splashing is visible.
I have observed what appear to be partial footwear marks in blood on the pavement between the body and the wall and on the road adjacent to the body. These marks contains pattern elements which appear to be different from the undersurface patterns of the shoes (JDB/2 to JDB/5) from Mr. SOMERTON and the boots (D3C/3 and DSC/4) from Mr. SEWELL.
SUMMARY AND CONCLUSIONS:-
Nothing has been found to show the presence of blood, other than his own on the clothing from Mr. GORMAN.
Nothing has been found to show that marks on Mr. GORMAN's face and on the ground in Chapel Street, had been made by items of footwear relating to Mr. TEAL, Mr. SEWELL, Mr. MOORE or Mr. SOMERTON.
Nothing has been found to show that blood from Mr. GORMAN had been shed onto items relating to Mr. TEAL, Mr. SEWELL, Mr. MOORE or Mr. SOMERTON.
Nothing has been found to show the presence of blood other than his own on items from Mr. TEAL.
The clothing from Mr. SEWELL bears blood from another person. In my opinion the findings show that Mr. TEAL is the person most likely to have shed this blood.
The clothing from Mr. M00RE bears blood from more than one person.
In my opinion the findings show that Mr. TEAL is likely to have shed some of this blood. The findings also show that some of the blood from Mr. MOORE'S clothing could have been shed by Mr. SEWELL. However Mr. MOORE cannot be excluded as a possible source of this blood.
In my opinion the findings show that the samples of blood from Page
Stair Lane are most likely to have been shed by Mr. TEAL.
In my opinion the findings show that the samples of blood from
Tuesday Market Place are most likely to have been shed by Mr. SEWELL.
