Time to come down.


Part one of my plan was acheived. I would of liked Karl to have got up as well but he was caught at the bottom of the makeshift rope. If your reading this Karl, you Donkey! Fortunately part two was acheived thanks to a visit from a friend. No sooner had he come to visit us then he was on his mobile ringing the press and local TV stations. Within the hour television crews and reporters were arriving. i remember him shouting up questions to me as he was giving interviews over the phone. It was now time to display the banner I had made from a pillow case. With the words SET UP in bold black letters. You see for me that is what was happening. I was being framed for a Murder I didn't commit or have any knowledge of. Like I said when I started this Blog, I knew Rod and I hadn't done it. I thought the Police couldn't be wrong about all of us, so I assumed Karl must of done it. How very wrong I was. As I started to see the statements I realised Karl had been dragged into this because he had come and got me from inside the club when Gorman was ouside playing up.
Anyway back to the roof, I have to congratulate the Officer who talked me down, he did a great job playing on my good nature. He talked for hours on how he would probably lose his job as negotiator for not getting me down. So in the end I gave up. We had the publicity we wanted. Henry Bellingham my M.P. had agreed to look at the case and start asking questions on our behalf. Obviously he couldn't get involved in the case per say. But what he found strange and it was something that certainly worried me ,was how long forensics were taking to come through. I had spoken to an inmate who was charged with murder in Ipswich. He had been involved in a fight with some one who had died as a result of it. Within a week Forensics had come back linking him to the Murder. An eyebrow of the dead man was found on his shoe after he had kicked him. So here I am in prison for 3 months and every week I have to listen to Philip Charnley the prosecutor stand up and explain why there was no Forensic evidence yet. Excuses varied from the forensic expert was away on a course then a family member had died and he was on compastionate leave. It went on and on. It played on my mind so much, that's how I can still remember it so well Mr Charnley! I thought they was going to fuck about with it, I mean they'd done everything else to keep me banged up. It would be the middle of June when the forensic evidence came back. There was nothing to link any of us with the fight on Gorman. I will post the results later. I should add that when I talk about this Murder and and use the words we and us, I'm taliking about Rod, Karl and myself. Gary Withers the other man who was eventually charged is not included. I will get to Withers and a friend of his later.

Roof Top Protest



I realised justice wasn't taking it's proper course. So I came up with the idea to go on the roof of the prison to get some publicity to highlight our case. It was getting me down that nothing seemed to be getting done. On my weekly visits to court the prosecutor would stand up and say he had this evidence or that statement but nothing was produced. It turned out he had being misleading the court by using a statement against Karl that had previously been withdrawn by the witness. That person went further than just withdrawing the statement he went on to make allegations against the Police which I will come to later. Anyway I'm getting pissed off. I shared a cell with a prisoner who had been in the Navy. I asked him if he could make a rope out of bed sheets. He assured me if their was one thing he had learn't in the Navy it was how to tie knotts. So I put my trust in him and collected as many sheets as I could. D Day arrived and the plan was that while Karl and I were having exercise in the yard a disturbance would occur in the kitchens. When the alarm bells sounded that was the signal for my cell mate to start throwing the make shift rope out of the cell window. It makes me laugh when I think about it. I had just struck up a conversation with a Prison Officer and the bells went off. The Officer had his back to the prison and as I was talking to him I could see this knotted rope been lowered from a cell window behind him. I asked him if he had to attend the disturbance and unfortunately he did not. He must of seen me keep glancing behind him and he turned round to see what was happening. I could see that my best laid plans ( I knew Of Mice and Men would come in handy one day )were about to go a rye. So I said to the Office "sorry about this" and pushed him to the floor. I immediately ran for the rope and started to climb up it. I was about 30ft up these knotted sheets when I could feel I was being swung about by Prison staff on the floor. There was lots of shouting and cheering and luckily for me the Officers stopped. I didn't fancy kissing the concrete floor beneath me and I made it to the top.The papers said I climbed up scaffolding but I can assure you there wasn't any scaffolding in the exercise yard. So thanks to my Navy friend and a bit of sweat I was on the roof. I immediately threw a note down to the watching screws and assured them that what I was doing had nothing to do with Prison conditions. I also wrote that I didn't intend to do any damage.

RE: Shelley Mitchelson

I want to go through Shelley Michelson’s statement with you, to highlight a couple of things. Firstly she sees and is able, to give a fairly good description of me when I throw Gorman out of the club. She says “The bouncer I would describe as being well built, average height, aged 35 onwards, blonde short hair. He was wearing a light coloured shirt, a dark colour necktie & dark trousers.” She goes on to say, “Having thrown the man out, the bouncer returned into the bar area within a matter of seconds, indicating to me that the bouncer had just thrown the man out & returned.”
For me that’s a pretty good description of what happened. Having left the club she describes Gorman arguing outside. She goes on to say she saw him lying on the stairs half way down. She is only 1 of a number of people who describe this event. Like I said earlier at least one person names a person thought to be responsible for it. The Police chose to ignore this. Her statement was taken on the Sunday, the day after the murder. She is able to give a description of one of the attackers was wearing a blue and white hooped rugby shirt she says he was wearing jeans had short dark hair was in his early 20’s and 6’-6’1” tall. Now you would think with a good description like that to go on the Police would at least ask and remember this is a Murder inquiry after all. You think during interviews they would at least ask about this man. Well wouldn’t you? Come on even bloody Inspector Clouseau might have twigged that one. Not the Boys in Blue from King’s Lynn. No one, before I was charged was ever asked about anyone in a blue and white hooped rugby shirt. Gary Sewell who was with Gorman and interviewed 4 or 5 times was never asked about this man. Are you beginning to understand the total fucking incompetence of the people concerned in this investigation? Believe me it gets much worse.
So if you have read Shelley Michelson’s statement do you think there is anything in it that incriminates me? I’m hoping like me you don’t. So listen to this. Rod and Karl and I were in court, our Solicitors were making bail applications. I think I am right in saying Rod’s was successful. Karl’s was turned down because he had (wrongly) been identified by a witness. Mine was turned down because Shelly Michelson had received a death threat. There was no mention of it when Rod and Karl’s solicitor made their applications, only mine. Apart from the fact at that time we did not know who had said what; please tell me what in her statement incriminated me? I remember it as plain as day. A policeman came into the court during my application, spoke to the prosecutor and it was suddenly announced that there had been threats made to Shelley’s mother over the telephone that very morning saying Shelley would die. Is it starting to smell yet? It was my belief then as it is now that it looked like I could be getting released from prison so a Copper made the threatening phone call knowing full well that it would stop my being released. I just can’t see any other reason for it.

I am the above named person; I am a Packer at R.G.Packers, King's Lynn. I live at the stated address, with my mother ILENE, younger sister AMY, my older brother CLIFFORD, my brother JASON who is 21 years old and my younger brother TONY. I am 20 years of age, about 5*4" tall, slim build and I have short dark brown hair. I am engaged, a have been for about 14 months to Gary DAW. During the incident: that I am going to describe, I was wearing a flowered pattern dress, that in fact has a shorts lower part & this was a various brown colour. About 9.30 pm on Friday 1st March 1991, I left my home address with my fiancé, GARY we walked into King's Lynn town centre & went to the Maids Public House, arriving between 10-15 minutes later. GARY & I stayed in the Maids for about 30 minutes, having just the one drink. I drink brandy & lemonade, Gary drinks lager & lime. On leaving the Maids we walked across to the Cellar Bar, in Paige Stair Lane. On going into the bar area I was surprised to find that it was not packed. On previous occasions that I have been into the Cellar Bar it has always been packed, but on this occasion this was not the case. I cannot say how many people were there but it was easy to move about & get to the bar. We got our drinks & stood at the bar, where we remained all evening. Between 10-30 pm-11 pm, I think about 10.45 pm, GARY & I were joined by my brother CLIFF, whose surname is ELLIS, GARY'S brother Wayne DAW, Mark BRANHAM, Jason COLEMAN & 2 other boys who I only know as TERRY & COLIN, who are Mark BRANHAM's friends. They stayed with or around us all evening, apart from now & again popping off to speak to other people they knew. By 11 pm the bar was absolutely packed & I had thought about leaving because I am asthmatic & I was having slight difficulty breathing. GARY persuaded me to have another drink & having had that, I felt much better so decided to stay. During the evening the only other people that came into the bar, that I know, were GARY's cousin, SANDRA, I don't know her surname and DAWN I don't know her surname but I know she works at Bespac. DAWN was wearing either a black suit or black dress; she has blonde hair & is in her 20's. Sometime during the evening I have no idea of time, I heard quite a loud bang. I did not see what caused the bang, as the bar at the time was packed, but from what other people said, in the bar at the time, I gathered that one of the TV / video monitors had been either knocked off its stand or punched off but, it had most certainly been damaged. The monitor damaged was the one furthest from the main entrance door, at the disco end of the bar, the other monitor being at the main entrance door end of the bar. Not too long after this had happened, I saw a bouncer, who I will describe, have hold of a man by his shirt, around the throat. The bouncer pulled this man, who I will also describe, through the bar & towards the main entrance / exit door. I did not see him go outside as the gangway that the people had made closed up as he was pulled through. The bouncer I would describe as being well built, average height, aged 35 onwards, blonde short hair. He was wearing a light coloured shirt, a dark colour necktie & dark trousers. The man who he'd had hold of was, I remember best by his shirt. The shirt he was wearing was a red & white striped rugby shirt, the stripes being fairly thick, about 3 1/2"-4" in width a going around the body, rather than up a down. He was also wearing jeans & I think trainers. He had blonde hair that was cut short, not in a skinhead style, but very short & due to the colour you couldn't really see his hair. He was fairly well built & I think shorter than the bouncer. I would add that I did see the bouncer have hold of the man, by the shirt, pressed up against an upright pillar / staunchon in the middle of the bar. This pillar has a shelf around it, used by customers to stand their drinks on. Having thrown the man out, the bouncer returned into the bar area within a matter of seconds, indicating to me that the bouncer had just thrown the man out & returned. Standing at the bar I was able to see a T.V. monitor, that is positioned on a shelf behind the bar that enables the Cellar Par staff to see who is outside the main entrance door. On the monitor, which shows the bottom of the stairs & about 2/3 steps up; I could see the man who the bouncer had thrown out. He just stood, on the first step, for about 15-20 minutes, at which time I looked & he was not there. From the time the man disappeared off the monitor to the time GARY & I left the Cellar Bar, which was about 30 minutes later, there were no other incidents inside the bar that I am aware of. The procedure at closing is just for the staff & the bouncers to announce that the bar is closing. Within about 5 minutes of being made aware the bar was closing, GARY & I finished our drinks & made our way outside.I would say that we must have been one of the earlier people to leave, due to the amount of people left inside, the bar. I think we left before CLIFF & the rest of our little group. As GARY & I were walking up the steps, from the Cellar Bar, I saw the man with the red & white rugby shirt leaning against the wall of the building, between the steps down to the Cellar Bar & the doors of the Snooker Club. GARY & I walked passed him & having got just passed, I heard someone, another man, who I will describe, say "I don't want no trouble'. GARY & I stopped & turned to see what was happening. I saw the man with the rugby shirt, had grabbed hold of the other man by his jacket. This man, the one who had been grabbed, I would describe as having black curly hair that had obviously bean permed. His hair was cut in a way that it was cut short, infact shaven, at the back, to the top of his ears. The sides had also been shaved, but, the permed hair laid over the shaven area, leaving a distinct stop hair & flesh / skin / scalp. He was shorter than the man with the rugby shirt, aged about 20 years & he was wearing a light coloured, possibly a khaki colour, jacket. I cannot remember what other clothes he was wearing. GARY & I wanted no part in any trouble so, having stood there for only a matter of a few seconds we turned & started to walk towards the Tuesday Market Place. We had only walked a few paces when I heard some shouting so we turned again & walked back towards the Cellar Bar & stopped at the railings looking down the steps at the main entrance door (the railings look into the main entrance which is about 10' below road surface level), We stopped at the railings, level with the middle flat of the stairs. On looking down I could see the man with the rugby shirt, laying on the steps between the middle flat & the bottom. I could also see DAWN who I have mentioned earlier, being helped to her feet by a man. DAWN was on the middle flat. The man who helped DAWN to her feet could have been the man with the permed hair. I could see that DAWN was crying. I saw the man, the one wearing the rugby shirt, trying to get up but I walked away from the railings before he had made it to his feet. I cannot say how the man got to be laying on the stairs or for that matter how DAWN came to be there as well, due to the fact that when GARY & I walked back to the railings my view of the incident was blocked, by people between us & the 2 men at the top of the stairs. I would say that there were 12 or more people closer to the area of this incident & because they would have been so close, many of them couldn't have failed to see what actually happened. On walking away from the Cellar Bar, GARY & I walked across the T.M.P. diagonally down Market Lane, where at the end we turned right, walked alone Chapel Street & we went into Phoenix Taxi's office. This journey I would say took us between 2-3 minutes. We stopped at the door, as there were 4-5 people inside already & when GARY asked the man behind the desk, for the taxi, he was told it would be 15 minutes wait. The people waiting inside the taxi office I can only say were 1 female; who had light brown hair was down to her shoulders. The others were men & they, all were all aged 20-25 years. I said to GARY that we could easily be home, walking, in 15 minutes so that is what we decided to do. We walked back into Chapel Street, from the taxi office & we walked along the pavement, the taxi office side, towards the Lattice House. At that time there was nobody else on the street, either in front, or, behind us. As we were walking passed the car park, at the roar of The Dukes Head, & before we reached the junction of Chapel Street & Market Lane, I saw in front & running me towards, 4 people. When I first saw them they were running across Chapel Street diagonally from St. Nicholas Street heading straight towards the council offices. It became quite clear to me that it was one man being chased by 3 others. As the 4 men were running across Chapel Street I got the impression that the man being chased was the same man who had been thrown out of the Cellar Bar & involved in the stair incident. The one wearing the red & white rugby shirt. GARY & I had kept walking as the 4 ran towards us & as we reached the junction of Chapel Street Market Lane, the man being chased tripped on the pavement, & fell to the ground & ended up on his back. At this stage I took hold of my fiance's arm as I felt rather anxious because I felt that a fight was going to occur. My fears were well founded because within 1 second of falling the 3 men chasing him were on him. I saw the man on the ground move his head & arm & one of the 3 men, who was wearing a blue & white hooped rugby shirt (who I will describe later) kicked the man on the ground in the side of the head, above the ear. The kick was a very hard, deliberate, vicious kick. I saw his head move, with the power of the kick & I certainly gained the impression that this first kick had knocked him out. I certainly did not see the man move, at all, after this first kick. He did not see him, try to shield his head with his arms or try to defend himself or get up in any way. His arms were laying somewhere down by his sides or at least away from his head. Immediately after the first kick, the one by the man wearing the blue & white hooped rugby shirt, 1 of the other men joined in the kicking, kicking the other side of the man's head. Both men were kicking the man continually, in the head & face. Throughout this the man was still laying face up on the ground. He made no movement at all, which reinforced my original belief that the first kick had knocked him out. All the kicks, by both of the men, were really hard, vicious kicks. I would say that both men kicked the .man on the ground about 7-8 times each. During this kicking the third pursuer was partly hidden from my sight by the man in the hooped shirt so, I cannot honestly say whether he took part in the kicking. I tend to think he did not. During the kicking we walked very slowly to the Lattice House side of the Market Lane junction, I was terrified to go passed them, but was reassured by GARY that we would be okay as the kicking was taking place on the opposite side of the road I can say that throughout the kicking, GARY & I were little further than just the width of Chapel Street away. I could see quite clear what was going on as the road is well lit by the street lights. My view of the kicking was not obscured at any time; there were no cars or other vehicles pass by to obstruct my view. Immediately after the head kicking finished, I saw the man, who I tend to think did not take part in the kicking, bend down & lift up the fallen man's head, think by the back of his neck (he was still face up). I then watched this man punch him in the face about 6-7 times. I could clearly see, from my position directly opposite, that the puncher had his right hand under the fallen man's neck & he was punching him with his left fist. All the punches were reasonably hard but not in anyway as vicious as the kicks had been. During the punching I heard the man doing the punching say "Don't ever". If he said anything else I did not hear what it was that he said. GARY & I still walked very slowly passed the Lattice House & as far as I can remember all 3 men were at the side of the fallen man & the puncher was still bent down. I then looked away. GARY & I crossed the road, to the same side as the council offices, as we walked passed the small garden area at the side of the Lattice House. As we crossed the road I looked to where the fallen man had been punched & kicked a saw that the 3 men, who had kicked & punched him, had disappeared. I noticed that the fallen man's head was now on the road, his neck over the edge of the kerb & his body was on the pavement, not as it had been throughout the whole incident when his body & head were wholly on the pavement. His body was now laid not parallel with the kerb line as it was but, diagonally across the pavement & kerb. What I can say, for certain, is up until this time nobody had touched him other than his 3 attackers. It was at this stage that I then saw my brother CLIFF, MARK & some others, who I took no notice of, walked into Chapel Street from around the corner of the solicitor's building on the corner, of Chapel Street & St Nicholas Street. CLIFF walked over to GARY & I, the others remaining on the Lattice House side pavement. I still had a complete & clear view of Chapel Street, towards Norfolk Street & I can say that there were no other people in the street. CLIFF decided to walk home with GARY & I & we left the others walking along Chapel Street, as we walked down Austin Street, Pilot Street & home. GARY should be able to give an account of the whole incident, as we were together throughout the evening that is very similar to mine. Going back to the attacker who was wearing the blue & white hooped rugby shirt. The hoops / bands were about 2" wide & ran across the body. The blue was a pale blue colour. I can clearly remember that the hoops on his shirt were much narrower, in width then the hoops on the fallen man's shirt. I am fairly sure that the hoops were all over the body of the shirt & ran alternatively white & blue. The man himself was 6’-6’1” tall, stocky build & he had short dark hair. He was also wearing jeans & he was aged early 20's. I am very sure that I saw this man earlier in the evening in the Cellar Bar, standing only a few feet away from me at the bar. Unfortunately I am unable to give much of a description of the other 2 attackers; however, I would say that they were both aged 19-20 years, smaller in height & build compared to the attacker in the blue a white hooped shirt. I cannot separate, in my mind, between the second kicking man & the man who was the puncher, other than one of these 2 may have, I can put it no stronger than that, be the man with the shaven & permed hairstyle involved in the stair incident.
This statement was made from my recollection & as a result of questions put to .me by DC's ABBS & CHAPMAN in an office at King's Lynn Police Station, between 3.05 pm & 7.45 pm on Sunday, 3rd March 1991.

RE:Gary Daw. Why aren't alarm bells ringing?

Here we have a witness to the actual fight outside the Council Offices. He couldn't have been any closer a mere 20 feet away at one stage. As the fight is taking place he is walking towards it with his girlfriend, so he had a good chance to see what is taking place. So why didn't the bloody alarm bells ring when he says this;
"I did not recognize any of the three men who I saw chasing the other men. I think the first two men both had dark hair, and were tall and of medium to heavy build. The third man, who had been behind the other two at first, had either light or dark hair, I can't remember, and I think he was possibly shorter than the other two. I don't think any of the men would have had white shirts on or anything particularly light, because they would have stood out. I can't remember having seen any of the three men before that evening either in the Cellar Bar, or outside the Cellar Bar".
Shouldn't bells have been ringing even just a little bit at the Police station? I mean in his statment he said he recognised me as being a bouncer, he describes me throwing Gorman out. In his opinion no-one was wearing white shirts,not a mention of any blood on their clothing, 2 possibly all 3 had dark hair. So where the fuck do I fit in to this.
Let me just tell you something that happened when I went for the eight I.D. parades. The 1st night I had to turn them down as I was stood in the line up and I looked at the other people on it. I think there was 11 other men. They all had dark hair, some with stubbled faces. Not a thing like me. I said to the conducting officer you might as well stick me up here with 11 black men or 11 coppers in uniform. Anyway the I.D parades were cancelled for me that night. But the next night one of the witnesses actually picked out a lad much shorter than me with dark hair.
In the toilets, after all 8 had failed to pick me out I was really happy. Then Insp Colin Langham-Fitt came in and said “I don’t know what you’ve got to be happy about because we’re charging you regardless of the identification parades”. I couldn’t believe it. Although at that stage I wasn’t aware of what evidence they had pointing my way I realised then that something was going terribly wrong.

I am Gary David DAW and I live at the address stated overleaf where I have lived for most of my life. I live there with my mother and father, and my twin brother WAYNE. About 9.15 on the evening of Friday, 1st March 1991, I left my house and drove to my girlfriend's house, Shelley MITCHELSON, who lives in Raby Avenue, King's Lynn. I drove there in my red Ford XR3, registered number: C434VX3V. I left my car parked outside my girlfriend's house, and the two of us then walked into King's Lynn town centre. The first place we went into was the Maydens Head on the Market Place, King's Lynn. We would have arrived there at about 9.30pm to 9.40 pm. We only had the one drink in the Maydens Head as it was quite busy and so we left at about 10.15 pm. We walked from the Mayden’s Head, directly across the Tuesday Market Place to the Cellar Bar, in Page Stair lane. When we arrived I think there were two bouncers on the door. I am quite a regular at the Cellar Bar, going once or twice a week, usually on a Thursday or Friday night. I do not know the bouncers but I recognised them as having worked there before. They were both dressed in black trousers, with white shirts and ties. I think they were also wearing black jackets. When I went into the actual main bar area it seemed fairly quiet. The place does not normally get full until the pubs close. I can't remember whether there was anyone in the club who I knew. The club started to get busy just after 11.00 pm when the pubs were shutting. Some friends of mine arrived about 11.15 pm; Clifford ELLIS (SHELLEY'S brother, who lives at 11, Raby Avenue); Jason COLEMAN (150 Columbia Way); Mark BRAMHAM (13, Newlands Avenue); and my brother WAYNE. They were with two friends of MARK's, COLIN and TERRY, but I don't know their surnames. The only other person in the club who I knew by name was WAYNE's girlfriend Sandra SMITH. I spoke to other people in the club who I know only by face, through football, as I play football for St. Margaret’s in the Sunday league. At one point during the evening a man with short blond hair, in a skin head style, who I think maybe, was losing his hair, spoke to me. I think it was about 12.00 midnight, though I cannot be sure as I was not keeping track of the time. He was wearing a shirt with red and white squares on it, but I can't remember what trousers he had on. He asked me whether I knew somebody whose name he mentioned. I did not know the person, and I can't remember what the name was. He asked me this about 2 or 3 times and then I walked off. I got the impression that he thought I knew who he was talking about, which is why he had asked me two or three times, and he seemed a little annoyed that I couldn't tell him who he was. Most of the evening SHELLEY and I were standing in the middle of the long part of the bar. At one point in the evening, probably around 12.15 am to 12.30 am, I was upstairs in the toilet, when I came down again I saw that a television which is normally on the wall near the bottom of the stairs inside the club, was missing. I could see that there was broken glass from the television screen lying on the floor, though I didn't see the television itself. I did not hear the television smash and I can give no account as to how it got broken. Later on in the evening just before the club was about to close, I saw one of the bouncers ejecting the man with the blond hair who I described earlier. I saw the bouncer walk him to the door, holding him with his hands around his neck. He walked him to the door, and I could not see what happened then. I then looked at the close circuit television which is behind the bar and I could see the man who had just been ejected standing two or three steps up from the doors. I did not see what had led up to the man being ejected, or what he had done to be ejected. A short while later, probably about ten minutes, I left the club with SHELLEY. We walked through the doors, and walked up the stairs. At the top of the stairs I again saw the blond haired man. This time he was arguing with another man who I would describe as stockily built, either curly or permed hair, which was quite bushy, and black in colour. He was clean shaven but I can't remember what he was wearing. I have seen the man in town before but I don't know who he is. I hadn't seen the man in the club that evening and the first time I saw him was at the top of the stairs. The blonde haired man looked to me as if he was trying to pick a fight with the other man. There were a few other people standing around watching them, but I didn't know any of them. There was also a lot of people leaving the club at the time. We walked past the two arguing men. Whilst we walking up Page Stair Lane towards the Tuesday market Place, I heard the noise of girls screaming coming from behind me. I stopped and turned around to see as many as half a dozen people, I think mainly men, either falling down the stairs or chasing somebody down the stairs. I could no longer see the blonde haired man standing at the top of the stairs. I then carried on walking with SHELLEY, towards the Tuesday Market Place. We had intended to walk to her house, but as we walked along the edge of the Market Place, about half way across the Market Place, SHELLEY decided she wanted to get a taxi home and so we walked right across the Market Place to the little cobbled street between the two banks. We walked all the way down the cobbled street and at the end turned left and went into the taxi office at the end. Throughout this walk there was only SHELLEY and myself together. No-one else was with us. We asked the man who was working in the taxi office (which used to be Glebe), how long it would be before we could get a taxi. He told us that we wouldn't get one for at least 15 minutes and so we told him we would leave it, and decided to walk home. At the time there was I think just one other man in the taxi office and about five or six girls. I did not know any of these people. We came out of the taxi office and started to walk home, along Chapel Street, towards the Lattice House. As we reached the comer of the Lattice House, having just crossed the little lane which runs between the Lattice House and the Dukes Head Hotel, I saw the blonde skin-headed man running towards me. He was on the same side of the road as us at first and then he crossed the road to the other side outside the Council offices. I got the impression that he had run from the direction of St. Nicholas Church and thought he must have run past the Tudor Rose, right to the end of the road and then turned right into Chapel Street. I then saw that he was being chased by three men. At this time the men were about 20 feet behind the blonde haired man. The three men caught up with the other man just outside the Council offices, about level with the main entrance door of the Council offices. Two of the three men were a little way ahead of the other one, who didn't appear to be running. Those two men then punched the blonde haired man to the ground, with only one or two punches. The man fell to the ground and the men then started to kick him repeatedly. I can't remember whether they kicked him with both legs, or just kept using one leg, but they kicked him a number of times. They were mainly kicking the man on his head, rather than kicking his body. At the time this was happening, SHELLEY and I were level with them though we were on the opposite side of the road. The third one of the three men joined the other two just as we had walked past. I cannot say whether or not he had also kicked the man on the floor, but I saw he was bent down over the man, and I think he was punching him. SHELLEY and I carried on walking away and then we met our friends from the club who were walking towards us. That is Clifford ELLIS, Jason COLEMAN and Mark BRANHAM. Clifford ELLIS came to walk with us, whilst JASON and MARK walked past. They were with a girl whom they had both been with all night. CLIFFORD, SHELLEY and I carried on walking away. I did turn round once to see the blonde haired man just lying on the pavement. His body was on the pavement but his head was hanging over the kerb onto the road. As far as I remember, I cannot recall seeing anybody else anywhere near the man lying on the pavement, either the three men I had seen chasing him, or any of my friends. We then walked down past the old Driving Test Centre, and so I could not see any more. None of the three men had run back past me and I didn't actually see where any of them went. I carried on walking until I got home. I did not recognize any of the three men who I saw chasing the other men. I think the first two men both had dark hair, and were tall and of medium to heavy build. The third man, who had been behind the other two at first, had either light or dark hair, I can't remember, and I think he was possibly shorter than the other two. I don't think any of the men would have had white shirts on or anything particularly light, because they would have stood out. I can't remember having seen any of the three men before that evening either in the Cellar Bar, or outside the Cellar Bar. I do not think I would recognize any of the men again if I saw them. Throughout the course of the evening I had consumed about 4 to 5 pints of lager and lime, and so I would not have been drunk, and my recollection of the events is quite clear. The curly haired man, who I had seen the blonde-haired man arguing with outside the Cellar Bar, was not one of the three men who chased him.

Ian Stocker Extracts

This is part of the statement of Ian Stocker a barman at the club he doesn’t see anything of great importance apart from the incident with Gorman playing up. Again no mention of me head butting Gorman, but what he does do is put a name to the person Gorman was confronting inside the club. This to me was important; it certainly showed the Police weren’t following all leads because as I stated earlier somebody else mentions Gorman getting knocked down the stairs outside by the same person. He was never questioned about it.
……”taking the television into the kitchen and at 1 o'clock we ail stopped' serving. At this point there were about fifty people left in the bar. I was behind the bar tidying up, when, after about five minutes I heard someone shouting. I looked up and saw the fair haired man apparently arguing with another man who I know as Tony. I know Tony because I play football with him on Sundays for the Reffley football team. He is about twenty eight years old, about 5'10" tall, stocky build, dark brown collar length hair, and wears a moustache. I think he was wearing a sweat shirt, I can’t remember what else. I don’t know his last name or where he lives, except it is in the Kings Lynn area. They were standing about two thirds of the way into the room from the entrance, near to the square central support column. This column has a shelf around all four sides for people to put glasses on. There was another couple, man and woman, standing by a table behind Tony. I got the impression they were with Tony. I would say they were also in their late twenties. I can’t describe them other than the woman had long brown hair. The fair haired man was doing all the shouting, pushing his face closer and closer to Tony. I formed the impression that the fair haired man was drunk, because he was argumentative and was swaying about on his feet. Tony just appeared dumb-struck by this and was gently trying to push the man away. As Tony pushed him away, the fair haired man lurched forward at Tony. I don’t know whether it was because he had had too much to drink or whether he was going to head butt Tony. Micky TEALE and Rob M00RE up to this point were still in the far left hand corner of the room. As Tony pushed the fair haired man away, Micky ran across to the group. He grabbed the fair haired man by the throat with both hands, and still holding him by the throat, pushed him up against the central pillar. I heard Micky say "Leave my mate alone." I found this remark strange because I don’t even think Micky knows Tony or vice versa. Micky spun the man around and pushed him hurriedly towards the door, with one hand on the back of the neck.”

This is extracts from the 16 year old glass collector he again doesn’t say much, but again no mention of a headbut when I took Gorman out. So did all these people miss it or did Steven Burke get it wrong?
…." I was in the kitchen, when I heard a loud crash, and so I went through to the bar area to see what happened. I saw that the T.V. at the rear of the room had been smashed on the floor. Myself and a D.J. who I don't know, but I believe he was called Simon, helped me carry the T.V. into the kitchen. Paul, who is the assistant manager, then went across to the D.J., and then the D.J announced he wanted everyone to drink up and leave. Paul asked me to clear up the glass from the floor. As I was doing this, I saw Michael TEAL with his hand around a man's throat, and his other hand went over the top of his head, so that he was pulling this man's head backwards with his fingers around his nose. He appeared to be frog marching the man towards the door and I just thought the man had been causing trouble, although I hadn't seen any. The man was about 5ft 10" tall, and quite a bit shorter than Michael TEAL. He had blonde skinhead type haircut. He looked about 24-25 years old. He was wearing jeans and a bright colored rugby shirt. I think it had red on it. Michael said to the bloke, "If you do that again while I'm here I'll ——" and then they disappeared outside, and I couldn't hear any more. I kept on sweeping until I had cleared it all up”.…..”Myself, Mandy, Donna the 5ft tall barmaid and 3 D.Js stayed at the Cellar Bar, and we went to sleep. At 0730 hours I went to King's Lynn police station and made this statement about what I saw to police”.
That concludes the statements from the bar staff. They all mentioned seeing me with blood on my face and shirt. Most of them used the words “covered in blood” to describe me I think it was Emma Regester that said I was bleeding “profusely”. It’s important to remember that for 2 reasons. The 1st is nobody who witnesses Gorman being chased or assaulted mentioned any of the assailants bleeding or with blood on their clothing. Let’s face it, anybody witnessing such a thing, even if they didn’t take particular notice to descriptions, the fact that one is covered in blood you would think might have stood out to at least one of them. The 2nd and probably more important was forensic evidence. 2 people that came into contact with me both had my blood on them. Gary Sewell and Rod Moore had their clothing sent off for Forensic examination and both had my blood on them. Strange then that the deceased Tony Gorman didn’t. I will post all the Forensic results at a later stage.

Re: Emma Regester

I’m not going to sit here and knock everyone who ever made a statement against me, that’s not my objective. But from past experiences I do know how statements are made, usually from a series of questions put forward by the Policeman conducting the interview. Her statement again is a good indication that the Police had already made up their minds as to who the killer was. Like most people she gets something’s right and something’s wrong. Let me give you a couple of examples. To do this I need to quote an extract from Mandy Groom’s statement, they are both describing the same thing. It’s where I came back into the bar after having a fight with Sewell. Mandy Groom States: - Micky was even aggressive towards Emma, the other barmaid. When he had come back into the Cellar Bar with blood on his face Emma had offered him some ice to put on his injuries, which he took, but he told her to "Fuck off".
Not very nice of me hey?
But Emma say’s this: - TEAL then wiped the blood off his face with his right hand and then spat blood all over the top of the bar counter. I said "Are you alright?" He replied "Yean." I said "How did you do that?" and he replied "I head butted someone." I then put some ice into a beer mat so that he could put it on his forehead and handed it to him. He threw it onto the bar and said "Don't worry about that, I'll do it when I get home."
So which do you believe?
Again I don’t think it helped that she was one of the 1st to be questioned. Just the little things piss me off, her saying “TEAL was in an aggressive mood throughout the evening and although MOORE was with him he was trying to calm him down all the time.” “All the time” apart from the incident with Sewell there was nothing to calm me down about. Even after throwing Gorman out, I was still Kool and the gang! Again there was not one statement taken out of the 170 or so customers that said anything about me been aggressive at ANYTIME during the evening, apart from the Sewell and Gorman episodes. After all I went through, there’s not a single person in this world who I hate. I’ve got to admit that’s not always been the case. For years afterwards I hated the Police with a vengeance. But for the most part I kept it to myself, I always told my kids to respect them, as they would never know when they would need them. Obviously for me 17 years on I still have a serious dislike for a couple of Coppers. Mandy Groom and Emma Regester should have stuck to what they knew, not how it appeared to them, or what they thought. Even today, I wouldn’t piss on them if they were on fire.

My name is Emma-Jane REGESTER; I am an assistant System Accountant and part time barmaid and live at the address overleaf. I work at the Cellar Bar, Page Stair Lane, Kings Lynn, as a part time barmaid. I work two nights per week and have been employed there for three months. The Cellar Bar is part of the Maltings Snooker Club on Page Stair Lane, Kings Lynn, and is situated in the basement of the building. It consists of a main entrance off Page Stair Lane which has two doors with yellow frosted glass, an emergency exit at the back which leads to the toilets, a main bar to the right as you enter through the entrance, a discotheque console to the left near the emergency exit and a television which is mounted on the wall to the left of the emergency exit. At 20:00 hours on Friday 1st March I arrived at the Cellar Bar with Mandy GROOM, who is also a barmaid in the Cellar Bar. I parked my car which is a silver MG Metro A172 PCT off Page Stair Lane immediately opposite the Snooker Club. When I got into the Cellar Bar the following people were present. Paul MYHILL the manager, lan who is a barman, I do not know his surname and Joanna who is a barmaid, I do not know her surname but she lives on Marsh Lane. There were two customers at this time, one was Peter GILB0Y who lives at Orchard Grove, West Lynn, and the other was a lad called Darren. I do not know his surname or where he lives. I was due to start work behind the bar at 2100 hours. When I arrived I sat at the bar on the customers’ side and ordered an orange juice. At 2020 hours Mick TEAL came into the bar, via the main entrance, he was wearing black cotton trousers, black leather shoes, a white shirt, a dark tie and a large grey overcoat. Mick TEAL is employed as a doorman at the Cellar Bar, I have known of him for several years solely by reputation but have known him personally for the last three months since I have worked at the Cellar Bar. Mick works at the bar every Friday and Saturday night. When he came into the bar he ordered a pint of Fosters Lager shandy and stood at the bar drinking it. After a couple of minutes he put his coat in the kitchen and immediately returned to the bar. He stood beside me, leaning on the bar and we had a conversation, nothing out of the ordinary was discussed. At 20:50 hours I went behind the bar to start work, Mandy GROOM and lan were also working behind the bar. The bar was fairly quiet throughout the evening and did not get busy until about 23:00 hours. TEAL remained leaning on the bar until 22:15 hours, during this period I served him with two pints of Fosters Lager and I know that the other bar staff also served him but I do not know what the drinks were. Two other doormen also work at the Cellar Bar on a Friday night they are Rod MOORE and lan, I believe lans surname is DIGGINS. lan came into the bar about ten minutes after TEAL and also stood at the bar, he was wearing a black casual jacket, black trousers, black shoes and a white shirt with a dark tie. He did not have a drink and shortly after he arrived he went and stood near the entrance doors. At 22:15 hours TEAL joined lan at the doors. Rod MOORE came into the bar at 22:30 hours, he was wearing black trousers, black shoes, a white shirt, a black casual jacket and a dark tie. I have known Rod only since I have worked at the Cellar Bar. As soon as he arrived Rod came to the bar with TEAL, and they both had a pint of what appeared to be lager although I did not serve them myself. They then walked back to the door with their drinks. After 23:00 hours the bar became very busy and was soon at full capacity. I remained behind the bar serving and was continually busy. About midnight the pressure system on the lager pump became faulty and I walked across the bar to the entrance doors to inform Paul the manager. I then walked back to the bar and as I walked past the central support pillar, which is near to the discotheque console. I pushed past a man in order to get to the bar and he gave me a really aggressive look, this frightened me. When I got behind the serving area of the bar I told Paul the manager. At some stage Paul must have told TEAL and MOORE because shortly afterwards they came behind the bar and TEAL said “who was he Emma, what did he look like?" I told him that I did not know who he was. MOORE also asked me who he was.TEAL then said “where is he. I’ll get him." TEAL appeared to be very aggressive and I got the feeling that he was looking for trouble. I did not want to identify the man that looked at me because I was worried what TEAL and MOORE might do to him. I remained working behind the bar when about 0045 hours the following morning I heard a loud crash from near the discotheque console. It sounded like a lot of glasses smashing and was easily audible above the sound of the disco. I initially thought that a fight was taking place but now know that the television had fallen off the wall. At this stage the bar was totally packed. I looked in that direction and saw people moving towards the discotheque console. I could not see what was happening. I remained behind the bar and after a couple of minutes everything seemed to return to normal. Several people then left the bar and the density of tile crowd thinned slightly. I then saw TEAL drag a man from the area of the emergency exit and then pin him against the central pillar by holding him around the throat with his left hand. TEAL had pushed the man from the area of the emergency exit in a similar fashion with his left hand round his throat. As he pinned the man against the pillar he was standing over him and pointing directly into his face with his right index finger. TEAL screamed at the man words to the effect "Don’t ever do that again." I looked at TEAL and he was in a vicious temper he then dragged the man across the bar and out through the entrance doors into the foyer beyond. TEAL pushed the man across the bar with his hands clamped behind his neck, the man did not struggle. When they got outside the entrance doors I lost sight of them but could hear TEAL shouting, I do not know what he was saying, I also heard scuffling as if a fight was taking place. Throughout this part of the incident I did not see lan or MOORE. I would describe the man that TEAL dragged out as follows. He is about 28 years old, he has very thick blonde hair which is receding at the front and short at the back, he was about 5'8" tall with a pale complexion and hard features, he was thick set and was wearing a red and blue rugby shirt, jeans but I do not know what he was wearing on his feet. I do not know this man by name but he has been to the Cellar Bar on previous Fridays. The scuffling continued in the foyer and Mandy and myself walked across to see what was happening, lan the other doorman followed us across the bar. I went to the bottom of the stairs, which lead up to Page Stair Lane, I saw TEAL at the top of the stairs, he had his back towards the building and was holding another man by the throat with his left hand, again he was pointing in the man’s face with his right index finger. He was still in a vicious temper and I heard him scream at the man "Don't you tell me how to do my job." He then viciously head butted the man on the forehead. I immediately came back into the bar and did not see what happened after the head butt landed. When TEAL head butted this man the following people were outside. Carl SxxxxxxxN who is a friend of TEALs, Paul FELLOWS who lives on the Reffley Estate, Bobby HILLS father, Bobby HILLS, Nicki HILLS, Debbie who is Rod MOORE'S Girlfriend and Rod MOORE who was standing beside TEAL. MOORE and TEAL had taken their ties off and Debbie was holding them. Debbie said to me "I wish they'd leave it up to Rod and Mick." She remained outside when I came back into the bar. The man that TEAL head butted is described as follows; he is about 24 to 25 years old, 5'9" tall, heavily built with short black hair. He was wearing a blue rugby shirt with jeans. I did not get a good look at his face but I believe he was Glen PRATT who lives at North End. I cannot be certain that it was him. When I returned to the bar I went behind the bar counter and' answered the telephone situated in the kitchen. It was Neil WILLIAMSON the owner of the Cellar Bar; I told him that there had been some trouble. Paul the manager than came into the kitchen and I handed him the phone. I then returned to behind the bar. The following customers remained in the bar. All the HILLS family as already mentioned, David STEWART, Danny SHEEHAN, Debbie (Rods girlfriend) and another male person about 30 yrs old, 6' tall, with mousey brown shoulder length hair and I believe a moustache. He was wearing a black suit with white shirt and a tie. He was heavily tattooed on his hands and neck. I have seen him before but do not know his name. lan the other doorman was also in the bar as were Mandy and lan the other bar staff. After about five minutes MOORE and TEAL came back into the bar through the main entrance. They came straight to the bar and both asked for a drink. I served them 1 pint of lager each. They were both covered in blood. TEAL'S shirt was open at the neck and heavily blood stained; his forehead was gashed in the centre of his forehead and was bleeding profusely, blood running down his face. MOORE'S shirt was blood splattered but was not as bad as TEAL'S. MOORE did not have any visible injuries. They were both breathing heavily and appeared to have been physically exerted. They were laughing and smiling at each other and appeared as if they thought they were heroes. TEAL then wiped the blood off his face with his right hand and then spat blood all over the top of the bar counter. I said "Are you alright?" He replied "Yean." I said "How did you do that?" and he replied "I head butted someone." I then put some ice into a beer mat so that he could put it on his forehead and handed it to him. He threw it onto the bar and said "Don't worry about that, I'll do it when I get home." TEAL then had a conversation with MOORE. I heard M00RE say to TEAL "You ought to calm yourself down, you go too mad." TEAL then said "I’m going to find him." or words to that effect and then stormed out through the entrance doors. He was in a temper again and MOORE followed him outside. After between five and ten minutes MOORE returned to the bar via the entrance doors. He came straight to the bar counter and said to me "Get me a drink." I served him with one pint of Fosters lager, his shirt was more undone at the neck than when he had left on the previous occasion and was unbuttoned virtually to the waist, it had the same amount of blood on it as it had before. His eyes were puffy and he looked as if he had been involved in a fight. He was very white in the face and was physically shaking all over. He appeared in a state of shock. I said to him “What’s happened?" He replied "'We went outside and we found the bloke who we chucked out laying in a pool of blood, face down, he looked in a bad way." He was very distressed and upset. He kept repeating "Mick didn't do that damage he just chucked him out." He repeated this about three times. I then said "Where's Mick?" He said "He's gone home." He repeated this several times. He also stated that when they had found the man Mick had run off looking for the other one. He did not say this to me but I heard him say it in the bar, I cannot remember his exact words. Shortly after this a policeman came into the bar and. asked MOORE if he was Rod MOORE. He replied "Yes." and then accompanied the policeman out of the bar. The same people were present when MOORE returned on this occasion as I previously listed when he returned with TEAL. I have not seen TEAL since he left the bar with MOORE. During the evening TEAL and MOORE both drank heavily. lan the other doorman left about 0130 hours and did not get involved with TEAL or MOORE. I cannot be certain what time MOORE returned to the bar on the last occasion but had only been in the bar about two or three minutes before the policeman arrived. TEAL was in an aggressive mood throughout the evening and although MOORE was with him he was trying to calm him down all the time. I am prepared to attend court on this matter.

It's important to read what injuries Tony Gorman suffered thet night, they were appalling. Months later when it must of been obvious to the Police and CPS that they had the wrong people,and by that I mean me, Rod Moore and Karl Sxxxxxxn ( notice I don't mention Gary Withers ). The Pathologist gives a second report in which he can't determin the cause of death. If the Police were addamant we were involved in the assault, then why wasn't a charge of G.B.H. pursued? For your information that charge carries a maximum sentence of life in prison.

Stamped On

Further Remand



I don't think Mr Charnley does high profile cases anymore, unless you count driving without insurance high profile, you know what I mean. What he failed to mention in court on that day was the person he quoted as having named Karl, had retracted the statement. He went on to make allegations against the Police which I will produce later. Karl's Solicitor did infact have 6 witnesses that made it impossible for Karl to have been involved. Trouble is the Police and the CPS weren't interested. They'd made their minds up too bloody early.

I am Steven John BURKE and I am 18 years of age. I live at the address overleaf with my parents Michael and Sheila BURKE. At present I am employed by Robinsons which is a VW and Audi Garage in Norwich. My role within the firm is that of a trim worker. Due to the work being in Norwich I live away from home during the working week and come home to my parents address on Friday nights. I usually stay the weekend with my parents and then return to Norwich during Sunday evenings. Since about the age of 14 years I have worked as a Disc Jockey (DJ) in my spare time. This is an occupation I enjoy and although the pay isn't good I do get enough to cover my expenses. I have not got my own equipment so as and when I have the work I hire the equipment from Paul WILLIAMS. For about the last 2 weeks me and my brother Michael BURKE aged 26 years have been contracted to The Cellar Bar to do entertainment for them. By entertainment I mean to act as their Disc Jockey (DJ). The Cellar Bar is situated in Page Stair Lane Kings Lynn. It is actually under the Maltings Snooker Club which is opposite Patrick and Thompson’s wood yard. The Manager of the Cellar Bar is a man I know as Paul. I’ve known Paul for quite a while as he uses the pubs and clubs that I use. Before Paul worked for the Cellar Bar he was the bar Manager at Chicago's Rock Cafe in Norfolk Street, King's Lynn. Me and my brother Michael got hired as DJs after Paul had approached first my brother then me. We must have been approached about 3 weeks ago just before we actually started working at the Cellar Bar. Michael and I are hired to work there Thursday nights Friday nights, Saturday nights and sometimes Sunday nights if there's a private function on. Usually we do alternate nights at the Cellar Bar but Michael always does Thursday nights because I'm always in Norwich during the week. Prior to working at the Cellar bar I didn't go in there very often. On the occasions that I did go in a man by the name of Micky TEAL was always in there. He was working there as a bouncer. I've known Micky TEAL for about 3 to 4 years. He's always been working as bouncers in the pubs and clubs I used to go in. Although Micky and me have never been best friends I've always got on well and have a laugh and a joke together. I've seen him do his job as a bouncer well in that anyone causing hassle gets escorted out of the premises by him until last night I've never seen him get physically violent towards anyone. I would describe Micky as easy going until you rub him up the wrong way and then he's not a very nice bloke to know. Other than that he's alright. Micky is a big bloke about 6'2" to 6-3" and he is a stocky build. He's got fairish blonde short hair and a strong bold face. I obviously know Micky well but find it hard to describe him as I've not really taken too much notice. I would say that Micky's size is quite imposing and he obviously takes care of his body and keeps physically fit. As I've already said I started working as a DJ at the Cellar Bar about 3 weeks ago. Micky TEAL was still acting as one of the bouncers at the bar. Usually they only have two bouncers on the doors but on the busy nights they usually have 4 to 5 bouncers on the doors Friday nights are the busiest nights. Up until last night during the time I've spent working at the Cellar Bar I had not seen Micky or any other bouncer causing any hassle or getting into any fights. The layout of the Cellar Bar is as follows. You enter the Bar by going down some steps until you get to the bottom where the entrance doors are. Once in through the door you get into an enclosed foyer type area. In the foyer is a desk and when the bar is open to the public a till is placed on the desk and anybody who wants to come into the bar has to pay one pound. Usually the bouncers hover around this area watching the punters coming in. Once in the foyer you then go through another door into the actual bar. Once through, immediately on your left is a TV monitor and to the left of that is two tables adjacent to the wall with seating in between. To your right once you get through the doors is a cigarette machine which is set right up against the right hand side well. In the centre of the bar area is a creamy white coloured pillar which goes from floor to ceiling. This pillar is quite large being about a metre wide. Around the circumference of it is a brown coloured ledge which is used to put drinks on. Usually a couple of high stools are placed near the pillar for people to sit on. Surrounding this pillar is about 5 smaller ones. These also go from floor to ceiling but they are not so wide. They are black, and made of metal. The best way to describe them would be to say they look like drain pipes. Although all these pillars are quite decorative they are there as a support for the ceiling. To the right of the premises near the cigarette machine is the actual drinks bar. The length of the bar is about 3 metres. Beyond the bar is the enclosed kitchen which is off limits to the public and beyond the kitchen is the drinks cellar. To the left of the premises after the two tables and seating there is a gap and then there is the console. The console is slightly curved and one end is fixed to the left hand side wall. The console is made of wood and the records and hi fi equipment are kept on ledges affixed to but behind the console. Beyond the console is one more table with seats either side and to the right of that is another TV monitor. The TV monitor is opposite the door to the kitchen area and between the two is another door which leads to the toilets. The TV monitors are used as entertainment. They show any television or they can be used with a camera to do close ups of people dancing. Once inside the Cellar bar the only way to get out are through the entrance door or through the door that leads up to the toilet and there is a fire exit. This fire exit is shared with the Melting’s. Punters who come into the Cellar Bar do not have to leave it to do anything. By that I mean it is self contained in one area. The toilets being the only thing you have to leave the area for. On Friday 1st March 1991 I left Norwich and got home to my parents house between 6 and 6.30pm. I got changed had a cup of coffee and an Ambrosia rice and then left my house. Before leaving I rang my friend Simon FOX to see if he was coming out but he wasn't there. I then decided to go round for my friend Paul RODWELL (known as Roddy) because I wanted some help to take my records down to the Cellar Bar as I was D-Jaying there that night. I cannot remember Roddys actual address but it is somewhere in North Lynn Kings Lynn. I left my house and got into my car which is a red coloured Skoda with a black vinyl roof. The index number of my car is written down somewhere but I can't remember what it is. I do know that it is 'X' registrated. I got to Ronny’s house and while there he quickly got changed and -then came out with me. I drove to the Cellar Bar and I arrived there at about 7.45pm on the same day and date. I parked my car outside the iron gates which front the steps that lead down to the Cellar Bar. Roddy helped me unload my records from my car and take them into the Cellar Bar and leave them near the DJ console. After we'd done this I then parked my car a bit further on down Page Stair Lane, King’s Lynn near the railings. I got back to the bar having done all this at about 7.55pm. On the same day upon my arrival the only people present were me and Roddy and the manager Paul. I started putting my records on the ledge then started mucking about mixing a few of them. Shortly after this between about 8.oopm and 8.30pm about 15 people had arrived out of these 15 4 or 5 of them were bar staff. Between 8.30pm to 9.15pm people started coming into the bar in dribs and drabs. I was playing music and the evening looked like it was going to go well. After about 9.15pm on the same day and date the Bar started getting fuller and groups of people were coming in and staying put. Again everything was going well. The place was getting full but everyone was in high spirits nothing happened that caused me any concern. At about 10.30pm on the same day I noticed that Micky TEAL had arrived. Micky was wearing a dark possibly black suit. He was wearing a white shirt but I don't know if he was wearing a tie. Prior to seeing Micky I had seen some other bouncers but I honestly can't remember how many I saw because they keep popping in all the time and it's impossible to keep a constant eye on them. My focus was on the crowd and my aim was to get then enjoying themselves. The evening carried on in the same way with people enjoying themselves and having a good time. I occasionally saw Micky was chatting to different people and there seemed to be no problems. Suddenly at about midnight I heard a thud and clashing sound coming from behind me. I immediately turned round and saw the TV monitor that had been between the kitchen and the seating and tables behind me was missing from its stand, Where the TV monitor had previously been standing a crowd of people had gathered I cannot say I knew anyone in that crowd. Micky TEAL then came rushing over and he started asking people what happened. I couldn’t really hear what was exactly said and I couldn’t see too much because so many people had gathered round. I continued playing music and tried to draw people's attention from what had happened near the TV monitor to the music I was playing. Micky TEAL stayed over near where the crowd was and I could see that he was mainly talking to a man who was about 6' tall, of a podgy build with black short spikey hair. He was wearing a red coloured rugby top which had another colour on it. I had not noticed this bloke prior to the incident and I do not know who he is. Micky and the man looked like they were having a quarrel although I couldn't hear what was said. I kept concentrating on my music but did keep having quick glances as to what was going on behind me. Micky and the man appeared to be arguing still and this must have continued for about 5 to 10 minutes. For about the next. 10 minutes after this I didn't look behind me as I was trying to keep the people’s attention on the music and not on the scene. When I did look round again I saw Micky dragging a blonde hair boy through the crowd towards the main entrance door. I would describe this boy as being in his early 20's with blonde thinning short hair. He was also wearing a rugby shirt but this was yellow in colour. This was the first time I'd seen this boy I do not know who he is. Micky and this boy appeared to be pushing and shoving each other so it was slow progress that was being made towards the door. All of a sudden Micky grabbed the boy with both hands by the throat and pushed him up against the middle pillar in the Cellar Bar. Micky obviously lifted the boy off the ground by the throat because I saw the boy rise quite high. The boy’s back was against the pillar. I then saw Micky throw his head back then forward and he head butted the boy straight in the face. This was a hard head butt because I saw the boys head fly back and hit against the pillar he was being held against. I couldn’t hear what was being said through all of this. After being head butted the boy looked shocked. I did not see any blood on either Mickys or the boys face. A crowd of people had formed and I couldn't see much of what happened next. I did see Micky drag the boy from the pillar towards the door. I couldn't see too much as people and the pillars were blocking my vision I think Micky was half dragging and half carrying the boy by his clothes. I tried to carry on as normal and by this it was about 12.45am on the morning of Saturday the 2nd March 1991. The crowd didn't really respond to the music and some started wandering off. At about 12.55am on the same day and date I slowed the music down in anticipation of the Bar shutting at 1am. A few people started having a slow dance. Paul the manager then came up to me and told me to stop the music and end the evening. I did that and thanked everyone for coming. After I'd stopped the music someone switched on the lights so the Bar was more illuminated than it had been. A few people were standing around finishing their drinks. I then heard a scuffle coming from the area of the entrance door. I looked but couldn't see what was going on because again a crowd had formed. I stayed where I was at the DJ console packed my things up and switched the hi-fi system off. People then started drifting off out through the front entrance doors so the scuffle was obviously over. After about 10 minutes the place was almost empty. By this time it was about 1.15an a couple of people remained in the Bar because they were talking to one of the bar staff. I then saw Micky TEAL come into the bar. He was wearing just his shirt and trousers. His shirt was undone a bit. I could see that blood was all over the front of his white shirt and down the sleeves of his shirt. I could see he was hyped up. He went straight to the bar after talking to a bouncer at the entrance door. When he got to the bar he said "Give me a fuckin drink". I heard the barmaid say "No”. I began talking to Simon F0X who'd arrived earlier in the evening and then I went to the toilet so didn't see what happened. When I got back from the toilet I saw that Micky TEAL had gone. Me Simon FOX, Roddy, Paul the Manager and another barmaid and Jason the glass collector all sat down and tried to sort out what had gone on. I forgot to say a barman called lan was also present. We were all pissed off because the night had been ruined. After about 20 minutes at about 1.45am I saw that a policeman had arrived. Paul, the manager had gone to talk to him. Paul then came back and told us no one was allowed to leave. After a little while the same group which had been talking, including me went upstairs to the Maltings and it was then we were told someone had been killed. We remained in the premises and after a short while the police arrived and interviewed each one of us. During the course of the evening of Friday 1st March 1991 and the morning of Saturday the 2nd March 1991 I had about 3 to 4 pints of lager to drink. I was not drunk and my recollection of the incident is clear. At the time of the incident when Micky head butted the boy as I described the Cellar Bar was crowded and the only lights that were on were flashing disco lights. Despite this my view was clear and I did see Micky deliberately head butt the blonde hair boy he had against the pillar. This is the first time I've ever seen Micky being physically violent towards anyone. He looked hyped up and in a rage. This did not unduly worry me as I've seen other bouncers doing similar things and they only do it when they have to and people are causing then problems. I am willing to attend court if necessary.

Re: Steven Burke

Steven Burkes was probably not aware how important his statement would turn out to be. First let me correct a couple of things he says. The Cellar Bar never ever had 4 or 5 Doorman working at the same time any day of the week. Three was the most we had on. He goes on to describe the incident with the TV, his version differs from all the others, Sewell himself, describes me as having a joke about it with him. In his 1st taped interview this is what Sewell says, “then what happened later on in the evening is I got up off my seat and the television from behind me fell down and hit me on the back. The bouncers come over and err I explained to them that just fell off and hit me and they said that's no problem, They did joke about say oh you shouldn't chuck tables about but in all good humour, you know not causing any trouble at all”.
Quite a different picture to the one been painted by the young Mr Burke. Remember Burke along with Mandy Groom and others who I will introduce in due time are the 1st to be interviewed. They lit the fuse that would eventually explode the bomb….. It may seem trivial to you, but for me Steven Burke letting his imagination run away with him had far reaching consequences. Off the top of my head I don’t know how many people actually witnessed me taking Gorman out of the club but I will make a guess at about 20+. So where does Burkes descriptions differ from all those other witnesses? In his statement he says I actually head butted Gorman before taking him out. How is it that all the other witness statements, some in quite good detail miss that most significant event out? (Cos it didn’t bloody happen Steven). Again I go back to the fact that Burke and others sat about for hours discussing the evening’s events. He says “Me Simon FOX, Roddy, Paul the Manager and another barmaid and Jason the glass collector all sat down and tried to sort out what had gone on. I forgot to say a barman called lan was also present. We were all pissed off because the night had been ruined”.
They all knew or had seen me throw Gorman out, they all knew I had a fight with Sewell and had seen me covered in blood and they all knew it was Gorman who had been killed and of course they were all aware I had been arrested for it. So what did they do? They put 2 and 2 together and solved a fucking murder inquiry on their own. Well done the fucking lot of you. Excuse my occasional outburst it’s been a while since I read much of this. So if Steven Burke’s mistake wasn’t bad enough let me go on and explain some of the repercussions it had. The thing that stands out for me personally apart from the fact it wasn’t true was this, the pathologist based his second opinion on the cause of death on the information he had been given in that Gorman received a broken nose due to a head butt by me at the Cellar Bar. I want to add there was not one single statement that said Gorman had ANY injuries whatsoever in or around the Cellar Bar. I remember my solicitor telling me at court that the CPS were going to continue the prosecution solely against me, based on the second examination. So the Pathologist report was based on false information to start with, Stephen Burkes statement. The CPS were going to ignore the actual assault on Gorman by the three men who chased after him. Anyway read Stephen Burkes statement. Stephen I hope you are able to read through it again does it still ring true or do you at last realize what a balls up you made that night?
